Preliminary remark: The legation of Württemberg at the Baden court, which existed before 1806, was retained after Württemberg was elevated to a kingdom and was occupied until 1848 by an envoy residing in Karlsruhe. During the revolutionary period, Württemberg was represented only temporarily by an official observer in Karlsruhe, since the resumption of relations in 1851 by a chargé d'affaires, until after the establishment of the German Reich in 1871 the legation was lifted. It was rebuilt in 1893 mainly for reasons of courtly representation. Until its final abolition on April 1, 1933, the Württemberg envoy at the Bavarian court, who was also accredited in Darmstadt, was also an envoy in Karlsruhe with headquarters in Munich. The volume of work was relatively high and varied in the initial period up to about 1820 - this becomes clear, for example, in the territorial negotiations at that time or in the large number of uses in private affairs - and then fell noticeably, so that envoys von Bismarck could be called upon several times for special missions to northern German courts. After 1850 the mutual consultations between the Württemberg and Baden governments on issues of major European and German policy as well as the internal problems of both countries intensified. In addition, the increased administrative intensity and urgent questions of economic legislation were now also reflected in the business volume of the legation. After the reestablishment in 1893, the envoy was given almost exclusively formal tasks and those of representation. As a rule, he spent a few days in Karlsruhe once or twice a year, usually on the occasion of the court ball or another court event. Negotiations between Württemberg and Baden authorities were usually conducted directly, no longer via the envoy, so that his correspondence - about 100 diary numbers per year - was largely limited to the transmission of congratulations, inquiries and official correspondence and occasional indirect reporting. With the end of the monarchy, these tasks were almost completely eliminated. However, the legation was formally retained and from 1926 on again entrusted with smaller commissions, such as reporting in Baden newspapers. The tradition is not homogeneous. In the first years individual case files predominate, from about 1815/1820 - as with other Württemberg legations - a purely formal classification principle, such as "concepts and reports" or "rescripts and notes" and correspondence files. Mainly new business areas were filed after 1850 by subject, such as "railway files". But it did not come to a continuous registry management, since the new fascicles were put on as required and, provided with a sequential Arabic number, were attached to the already existing files at the end. In this way, the registry consisted of 72 in 1848, 104 in 1866 and dates back to 1818. From 1893 - 1933 the entire written material was filed only according to the chronological order. The content of the written material is also very unequal. Some envoys took part of the processes, so their instruction, to their private files. A number of events only appear in the diary, as they were passed on in original form without additional documents being gathered in the legation. After 1893, for parallel enquiries to Bavaria, Baden and Hesse, often only one joint draft was produced and filed with the Bavarian registry. Some things seem to have been lost or destroyed, for example when the passport register only covers the period from 1811 to 1816. as far as can still be seen, the present collection was archived in four deliveries together with documents of the Ministry of Foreign Affairs and other legations and was added to the collection of "Legation Files" (E 70 and E 73). The documents summarised in inventory E 70 Verzeichnis (Ablieferung) 32 covered the period up to 1817, those of inventory E 70 Verzeichnis 33a the period from 1818 - 1871 and arrived after 1872. The material grown up in Munich was delivered until the year 1910 around 1920, the rest was probably incorporated immediately after the abolition of the legation in 1933 and the stock E 73 Verzeichnis 61. The reorganization could orient itself only little at the given condition. The archival records that had grown up at the legation were separated from the rest of the association and the provenance holdings "Württembergische Gesandtschaft in Baden" were newly formed. The originally planned division into two main parts, "I. 1806 - 1871" and "II. 1893 - 1933", was cancelled when the finding aid book was drawn up and all title entries were subordinated to the classification scheme prescribed by the distortion of other legations. Among them are the reports to the King or the Minister of Foreign Affairs and the general, not thematically limited correspondences with him, among others the first main group. The other files were separated according to their different subjects without regard to the previous state of order, and each of them was re-compiled into the other main groups. The breakdown of these was based on the total business volume. It was not advisable to align the plans with those of other legations, such as Berlin or Munich, which had been preserved. Certain inequalities in the distortion have remained in so far as some subjects, such as "German Question" etc., have been left out, Despite their complexity, a further subdivision was not permitted, whereas on the other hand after 1893 only individual cases still occur or until 1850 almost all affairs of private persons were classified under "Uses", but afterwards also under the subject headings such as "Reporting", "Justice - Individual Cases" and others.In the present finding aid book the indication of the registry signatures, i.e. the tuft counting with Arabic numerals, was omitted for the documents up to 1871, since they could be determined only partly without difficulties and references to these numbers are found only imperfectly in the last diaries before 1871. The previously valid archive signatures E 70 Verzeichnis 32 Faszikel 1-9 and E 70 Verzeichnis 33a Faszikel 1-33 were, however, noted in the title entries. Various old tuft numbers had to be applied when a new tuft was composed entirely or partially of old tufts. For the files from 1893 - 1933 the indication of the old archive signature could be omitted, since with the previous purely chronological storage - apart from isolated fact file beginnings - the written material from 1893 - 1899 was united in E 73 directory 61 fascicles 18 d, from 1900 - 1905 in 18 e, from 1906 - 1913 in 18 b and from 1914 - 1933 in 18 c.As diverse as the content of the title recordings may be, there are clear limits to their scientific evaluation: the continuous reporting to the king up to 1847 forms a closed whole, the other correspondence only covers partial aspects. The same often applies to the fact files, especially if minutes, excerpts or replies to enquiries were forwarded in original form. Parallel transmission is therefore of greater importance. On the Württemberg side, the holdings of the superior Ministry of Foreign Affairs and the State Ministry are to be mentioned primarily in the Main State Archives, on the Baden side in the General State Archives Karlsruhe the departments 47 - 49 Haus- und Staatsarchiv - II. The title recordings present on index cards were entered without substantial changes over screen into the system. History of the Inventor: Establishment of an office on 12 February 1919 for the processing of the duties assigned to the Reich President by the Constitution as head of state, at the same time official liaison office between the Reich President and the Reich and state authorities; transfer of the powers of the Reich President to the "Reich Chancellor and Führer" Adolf Hitler by the law on the head of state of 1 August 1934; retention of the office of the Reich President and renaming of the office to Präsidialkanzlei by ordinance of 4 September 1934. Inventory description: Inventory history In the 1930s, the office of the Reich President regularly handed over so-called "Weglegesachen" to the Reich Archives, for example in April 1932 and March/April 1935. However, the registry, which was still ready for handing over in 1944, with processes up to 1934, no longer reached the Reich Archives. In 1944, the archives already kept in the Reichsarchiv Potsdam were transferred to the galleries of Staßfurt and Schönebeck a.d.Elbe. The office of the presidential chancellery and the current registry were maintained at the end of the war in Kleßheim Castle near Salzburg. In 1942/1943 Schloss Kleßheim had been lavishly refurbished as the guest house of the presidential chancellery and the Führer for special purposes. After the capitulation of the German Reich and the occupation by the Allies, the archive holdings fell into their hands. For the files of the presidential chancellery, this meant, in accordance with the territorial division of the occupation zones, that the documents from the tunnels in Staßfurt and Schönebeck a.d.Elbe were largely transported to the USSR, and that the service records at Schloss Kleßheim were under American administration. During the Berlin blockade of 1948/49, the ministerial holdings subsequently brought together in the western sectors of Berlin were transferred to Whaddon Hall in Buckinghamshire and jointly administered by the Foreign Office of the United Kingdom and the American State Department. File returns from the Soviet Union to the GDR began in the mid-1950s. As part of the most extensive restitution campaign, the files of the Presidential Chancellery were transferred to the German Central Archive Potsdam (DZA) in 1959 and stored here under the signature 06.01. The holdings were supplemented in 1963 by further additions that had previously been assigned to the Reich Chancellery. At the same time, the files from American and English administration were transferred from the archive in Whaddon Hall to the Federal Archives in Koblenz. The inventory signature was R 54. After the unification of the two German states and the takeover of the Central State Archives of the GDR (ZStA) by the Federal Archives, the partial inventories were merged and are now stored in Berlin with the inventory signature R 601. 2,536 transactions from the NS archive of the MfS were incorporated during the current processing, the third comprehensive addition. The 1,213 volumes of files were broken down by administrative structure and provisionally recorded. In 1967 the provisional indexing took place in the Federal Archives in Koblenz and in 1981 the submission of a finding aid book to the 241 volumes under the stock signature R 54. After the consolidation of the partial stocks from Potsdam and Koblenz a complete finding aid book was submitted in 1998. At the end of 2008, the database-supported revision of the finding aid book and the incorporation of 2538 files with the provenance Presidential Chancellery from the NS archive of the MfS began. The present archival records are composed of files in their original order of origin, partly with the original file covers and in the predominant number of individual folders comprising only a few sheets. The stock grew from 1,581 files by 933 signatures to a total of 2,547 files. The majority of these are personal transactions such as appointments and dismissals of civil servants and awards of orders. However, it was possible to supplement the volume series with two fact files from the years 1926 and 1927 both chronologically and verifiably on the basis of the diary numbers with volumes 8 and 9. The five-volume series in connection with Paul von Hindenburg's honorary membership is a complete complement. Content and Evaluation The Supreme (Land) Government was founded in 1806 as a collegial authority in the execution of the manifesto of King Frederick I's organization. The name is also misleading, because the authority was not a government in the current sense, but only a department of the Ministry of the Interior with responsibility for the so-called Regiminal Subject. According to the opinion of the time, this included in particular the safeguarding of the royal sovereignty rights, police matters throughout the country with the exception of the residential cities of Stuttgart and Ludwigsburg, the supervision of all state officials with the exception of the administration of justice, and the confirmation of elections to magistrate and other offices, Issues of subjects' and citizens' rights including emigration (deduction and after-tax), participation in military conscription, matters of prisons, breeding, labour and orphanages, poor institutions, trade, commerce and crafts as well as fire insurance. Originally, the collection was divided into 59 bundles or federations, the contents of which were reproduced in the Marquart repertory (1912) only in keywords. - on the administrative history of the Württemberg upper offices: 1. the upper offices in their context (constitutional structure, "Staatsverein"): the administrative structure, which was created at the beginning of the 19th century for the double territory of the kingdom of Württemberg compared to the duchy, remained in place with minor changes until 1938, partly even beyond that. During this period, the Land was divided into 63 senior offices plus the Stuttgart City Council (1). The average area of an upper administrative district was around 1822 5.7 square miles = 316 square kilometres, the average number of inhabitants 20,700 (1926 : 41,604), whereby in the course of time a considerable imbalance resulted (the number of inhabitants per upper administrative district varied 1926 between 18,000 and 341,000). The four district governments, which replaced the twelve bailiwicks established in 1806 (2) in 1817, were the intermediate authorities between the individual upper offices and the ministerial level. The Württemberg constitution in force from 1819 to 1919 (3) was based on the municipalities as the "basis of the state association" (4). The higher offices had the task of bringing the administrative matters directly affecting the individual citizens, which the municipalities dealt with largely on their own responsibility, into the state administration. The problem of the greatest possible integration of all those affected by administrative measures arose for the higher offices as well as the problem of a uniform implementation of domestic government measures. The upper offices were also the constituencies for the elections to the Chamber of Deputies (5). 2. functionariesThe Ministry of the Interior delegated the responsibility for the higher office administrations to one senior official each, since the 1830s as a rule a lawyer with a university degree. In it the individual municipalities of an Oberamtsbezirk were combined as an official body. The number of deputies each municipality provided depended on its share of the public burdens to be borne jointly, the "official damage". The Official Assembly met twice a year. History of the Inventory Designer: Mirbach's Telegrafisches Büro (MTB) was founded at the beginning of the 20th century in the Rhineland as a small news agency by the editor Mirbach. Together with Professor Arthur Jung, he owned the "International Telegraph Agency (ITA)" in Cologne until November 1920. After separating from his cooperation partner Jung, Mirbach initially resumed work in his former correspondence office. The situation in the German Reich at that time played an important role in the further development of the MTB. After the defeat of the Imperial German Empire in World War I, the newly created Saar region, consisting of the southern part of the Rhine Province as well as the Saarpfalz and the western part of the Bavarian Palatinate, was separated from the German Empire by the territorial provisions of the Treaty of Versailles. In 1920 it was placed under French administration with a mandate from the League of Nations. The occupation of the Saar region by French troops was accompanied by the spread of French propaganda (1). This was mainly due to the purchase of some German newspapers, such as the "Südwestdeutsche Abendzeitung" by the French military administration (2). Renamed "Neuer Saar Kurier", the newspaper now appeared bilingual and was supplied with information by French news services. The German Reich government and the Foreign Office felt compelled to counteract France's efforts to separate the Palatinate. Similar efforts of the occupying powers could also be observed in the other ceded territories of Alsace-Lorraine, Rhineland, Eupen-Malmedy, Posen, North Schleswig, in parts of Upper Silesia and in the border regions. In order to counteract the propaganda of the occupying powers, the Reich government agreed to the proposal of the publishing director Kristian Kraus to create an intelligence service that would supply the ceded and occupied as well as the border regions with news from the German Reich. Kraus had been organizing the intelligence service for the Saar region and occupied areas of the Rhineland on behalf of the Reich government since 1919. This intelligence service should be further developed. Mirbach's telegraphic office was considered at that time to be the "management of the Rheinische Korrespondenz"(3). Kraus was interested in taking over the MTB, as he explains in a letter to the press department of the Reich government. After the negotiations between Kraus, Mirbach and the government the MTB was integrated into the "Reichsstelle zur Versorgung der besetzten und abgetretenen deutschen Gebiete mit deutschen Nachrichten". From 1920 to 1929, Kraus was the managing director and literary director of this Reich office, also known as the "Allgemeines Politisches Informationsbüro G.m.b.H." (General Political Information Office G.b.H.), based in Berlin (4). At the same time, the news agency Polwona was founded, also managed by Kraus, which opened several branches in the occupied and ceded German territories (5). These news agencies were outwardly issued as private-sector enterprises, but were financially dependent on the Reich. Daily messages were transmitted by telephone from Berlin to the Polwona branches. These were established in Frankfurt am Main (Frankfurter Depeschenbüro), Mannheim (Oberrheinisches Nachrichtenbüro), Saarbrücken (Saarkorrespondenz), Cologne (Mirbachs Telegraphisches Büro), Königsberg (Norel - Ost Korrespondenz) and Flensburg (Korrespondenzbüro Nordschleswig) (6). History of the Ministry: The Württemberg Ministry of Foreign Affairs, initially also known as the Cabinet Ministry and headed by two ministers, had existed since January 1, 1806. According to the Organization Manifesto of January 18, 1806, the Ministry of Foreign Affairs had been the "Ministry of Foreign Affairs of Württemberg" since then. By decree of 12 February 1812, this area was separated from the Ministry and an independent Ministry of Police with extended powers was set up. 8 November 1816, the Minister of Foreign Affairs was responsible for the organisation of the Privy Council, which was essentially the tasks described in the organisational manifesto. Only the post office was subordinated to the Ministry of the Interior, as far as it did not fall within the area of the House of Thurn und Taxis. The Chancellor of the Order, usually the Minister of Foreign Affairs, was now responsible for the affairs of the Order, while the Ministries of Foreign Affairs and of the Interior shared responsibility for the administration of the affairs of the nobility. A Royal Rescript of 19 July 1819 approved the division of the Ministry's internal service into two sections, a general political section and a legal section. The latter was responsible for political and diplomatic relations, the latter for consular and international legal assistance. The Transport Department, established in 1864 alongside the Political Department, supervised the general directorates of the Württemberg Posts and Telegraphs and the State Railways. The Ministry also included the envoys, consuls and other diplomatic agents, the Haus- und Staatsarchiv, the Lehenrat and the Zensurkommission until its abolition in 1848. After the foundation of the Reich in 1871, the Ministry continued to exist with limited responsibilities. After the President's decree had merged the Chancellery of the Political Department with that of the State Ministry with effect from 1 January 1920, the Foreign Ministry was finally abolished by the Act of 29 April 1920; the remaining tasks fell to the State Ministry. The overall registry: The records of the political department of the Ministry of Foreign Affairs were arranged according to a classification scheme. Within the individual categories, the files were usually arranged chronologically according to main fascicles, which in turn were arranged and numbered according to subfascicles. The headings could change over time (e.g. "uses"). If the order in the registry of the ministry had already been disturbed, it became completely unclear due to the numerous deliveries between 1872 and 1938 to the Haus- und Staatsarchiv; because these ministerial files, sometimes mixed with documents of subordinate authorities, were distributed among the holdings between E 36 and E 65, depending on the date of delivery. The order begun in the 1960s has the aim of forming "classified inventories" according to the categories used in the Foreign Ministry. The categories that belong together are grouped together in one inventory, whereas the categories "Varia" and "Uses" are dissolved and classified under the corresponding categories. Found condition and formation of the inventory E 40/72: The inventory E40/72 consists of the following categories:1. "War material" from the inventories E 36 Verz. 18, E 46 and E 52, extent approx. 3.3 running m2. "German Affairs 1866-1871" from the inventory E 41 I. Appendix, volume approx. 2.5 m3. "War" (concerning I. World War) from the inventory E 49 Verz. 12, circumference approx. 7.5 m4. "Uses" and "Varia" (concerning military matters) as well as documents without recognizable registry designations from the holdings E 36 Verz. 14 and 58, E 41 Verz. 63 and E 49 Delivery 1938, volume approx. 0.7 linear metres. m Accordingly, the larger part of the holdings consists of documents from the First World War. Obviously the formation of the registry at the ministry could not keep up with the general temporal development, because under the file number "War 1 General" serial files were formed, which comprised 41 bundles (altogether 5.5 m) with 16339 quadrangles when the ministry was abolished. The situation was similar with the file number "Krieg 4 Kriegsziele und Friedensschluss" (war 4 war aims and peace agreement) (a total of 1.5 m), although a distinction was made between general files and the classification by states. It was only gradually, especially towards the end of the war, that the creation of files was begun; documents were also taken from the general files, and it was therefore necessary to dissolve these two large blocks in favour of the principle of files. Moisture and mold damages were determined in places, whereby after consultation higher place with larger damages, above all with threatening further writing loss the documents were copied. Gaps in the general files are also striking; indications suggest that some documents were subsequently added to the legation files and to the "federal files" (B. A. ); individual secret files kept in the "iron cabinet" seem to have been lost. The extensive collection of newspaper clippings, which is now to be found in the fact files and represents a unique documentation, is also worth mentioning. Since the total stock E 40/72 is composed of chronologically arranged rubrics, the classification according to the principle of the fact files appeared necessary here as well; however, overlaps could not be completely avoided. Files from the Conference and Army Ministries were added to the holdings E 272 and E 273, documents from the provenance of the War Ministry were handed over to the Military Archives, and only duplicates and blank sheets were collected. Pagination applied to various clusters of the total stock has become obsolete. Stuttgart, July 1997Wilfried Braunn Preliminary remark for the new edition of the Findbuch 2011: During the incorporation of the oldest delivery of the Ministry of Foreign Affairs (former signature E 36) into the new inventory structure in 2007, it turned out that in particular in Verz. 60, which was arranged exclusively according to country categories, there were numerous other files concerning war and military matters. Since the content of these documents did not differ significantly from that of the documents already contained in E 40/72, a general classification in the holdings on general foreign policy (E 40/14 or E 40/18) did not appear to be in the spirit of the new resistance structure drawn up in the 1990s. In order to ensure that the structure of the inventory can also be traced from the user's point of view, these supplements were therefore incorporated into the existing inventory and the finding aid book was reissued due to its extensive growth. Geschichte des Bestandsbildners: Rechtsgrundlagen Zu Beginn des 19. Jahrhunderts herrschte in Deutschland mit 29 verschiedenen Patentrechten bzw. Privilegienordnungen jeweils territorialer Wirkung eine große Rechtszersplitterung auf dem Gebiet des gewerblichen Rechtsschutzes. Dieser Zustand wurde durch das von einer Patentkommission des Reichskanzleramts erarbeitete Patentgesetz vom 25. Mai 1877 (RGBl. S. 501) beendet. Dieses war mehr industrie- als erfinderfreundlich, denn der Erteilungsanspruch stand dem ersten Anmelder, nicht dem Erfinder zu, und Patente konnten gewerblich verwertet werden. Jedermann hatte das Recht auf Einsichtnahme in die Erteilungsunterlagen. Beschreibungen und Zeichnungen wurden von da an amtlich veröffentlicht. Obwohl die Möglichkeit der Lizenzerteilung an Dritte ohne Übertragung des Patentrechts vorgesehen war, unterlag der Patentinhaber drei Jahre nach der Erteilung einem indirekten Lizenzzwang. Die gesetzlichen Grundlagen für das Kaiserliche Patentamt bildeten das o.g. Patentgesetz und die Verordnung betreffend die Errichtung, das Verfahren und den Geschäftsgang des Patentamts vom 18. Juni 1877 (RGBl. S. 533). Der Patentschutz war aber noch nicht effektiv genug, und die Zahl der Anmeldungen stieg, so dass schon am 4. April 1891 ein neues Patentgesetz (RGBl. S. 79) erlassen wurde. In erster Linie verstärkte es die Rechte der Patentinhaber. Der Neuheitsbegriff im Sinne des § 2 des Gesetzes wurde eingeschränkt und unter bestimmten Voraussetzungen die Aussetzung der Bekanntmachung ermöglicht. Das Gesetz betreffend den Schutz von Gebrauchsmustern vom 1. Juni 1891 (RGBl. S. 290) war eine Ergänzung des Patentgesetzes und trat ebenso wie dieses am 1. Oktober 1891 in Kraft. Es war notwendig geworden, da das Gesetz betreffend das Urheberrecht an Mustern und Modellen vom 11. Januar 1876 (RGBl. S. 11) nur die sogenannten Geschmacksmuster, jedoch nicht die zur Steigerung der Gebrauchsfähigkeit dienenden Modelle (Gebrauchsmuster) schützte. Eine weitere Vereinheitlichung des gewerblichen Rechtsschutzes brachte das Gesetz zum Schutz der Warenbezeichnungen vom 12. Mai 1894 (RGBl. S. 441). Auf diesem Gebiet hatte es bis 1874 lediglich regionale Zeichenrechte gegeben. Das Gesetz über den Markenschutz vom 30. November 1874 (RGBl. S. 1943) hatte die Zuständigkeit für die Registrierung den Amtsgerichten zugewiesen. Nun oblag auch diese Aufgabe dem Patentamt. Das Gesetz betreffend die Patentanwälte vom 21. Mai 1900 (RGBl. S. 233; neugefasst durch das Patentanwaltsgesetz vom 28. September 1933 (vgl. RGBl. II S. 669) führte eine Liste von berufsmäßigen Vertretern im Verfahren vor dem Patentamt, eine Prüfungskommission und einen Ehrengerichtshof für Patentanwälte ein. Starke Reformbestrebungen seit ca. 1900, die 1913 zu einem Entwurf der Reichsregierung für ein neues Patentgesetz nebst Gebrauchsmustergesetz führten, wurden durch den Ausbruch des Ersten Weltkrieges unterbrochen. Sie wurden ab 1927 wieder aufgenommen, konnten auf Grund der innenpolitischen Verhältnisse aber nicht sofort durchgeführt werden und fanden ihren Abschluss erst in den Gesetzen über den gewerblichen Rechtsschutz vom 5. Mai 1936. Das Patentgesetz vom 5. Mai 1936 (RGBl. II S. 117) brachte hauptsächlich dem Erfinder zugute kommende Änderungen, darunter die Ersetzung des Anmelderprinzips durch das Erfinderprinzip, die Unterstützung mittelloser Erfinder und eine Neuheitsschonfrist. Das Patentrecht sollte das geistige Eigentum des Erfinders schützen. Durch das Gebrauchsmustergesetz vom 5. Mai 1936 (RGBl. II S. 130) wurden das materielle Gebrauchsmusterrecht und das Verfahrensrecht an das Patentgesetz angeglichen. Auch das neue Warenzeichengesetz vom 5. Mai 1936 (RGBl. II S. 134) brachte verschiedene Neuerungen. Im Zweiten Weltkrieg gab es neben der Einführung von Geheimpatenten und eingeschränkten Beschwerdemöglichkeiten auch im Interesse der Rüstungswirtschaft stehende Fortschritte im Arbeitnehmererfinderrecht. Aufgaben des Patentamts Die wesentlichen Aufgaben des Patentamts waren die Erteilung von Patenten und die Entscheidung über die Erklärung der Nichtigkeit bzw. die Zurücknahme von Patenten sowie die Erteilung von Zwangslizenzen. Daraus ergab sich eine Doppelfunktion sowohl als Verwaltungsbehörde als auch als gerichtliche Instanz. Eine Möglichkeit der Berufung gegen Nichtigkeitsbeschlüsse bestand beim Reichsoberhandelsgericht in Leipzig, ab dem 1. Oktober 1879 beim Reichsgericht. Einen besonderen Aufgabenbereich des Reichspatentamts in der Zeit des Zweiten Weltkriegs bildete die Vergeltung von Patenten. Auf der Grundlage des § 26 der Verordnung über die Behandlung feindlichen Vermögens vom 15. Januar 1940 (RGBl I S. 191) erließ der Reichsjustizminister in den folgenden Jahren mehrere Verordnungen über gewerbliche Schutzrechte bzw. Urheberrechte ausländischer Staatsangehöriger. Wurden deutschen Staatsangehörigen oder Unternehmen auf Grund fehlender bilateraler Abkommen oder Verträge auf der Grundlage von Ausnahmegesetzen Beschränkungen in der Nutzung von ausländischen Patenten auferlegt und in der Vergeltung ihrer eigenen Patente durch ausländische Firmen eine gegenüber den Bürgern dieser ausländischen Staaten abweichende Behandlung zuteil, so wurden sie für entstandene finanzielle Schäden durch das Deutsche Reich vergolten. An den in Deutschland wirksamen Schutzrechten ausländischer Staatsangehöriger konnten zur Wahrung allgemeiner Belange Ausübungsrechte an deutsche Firmen erteilt werden. Außerdem bestand die Möglichkeit, Patenterteilungen auszusetzen bzw. Gebrauchsmuster und Warenzeichen einzutragen. Die entsprechenden Anordnungen wurden vom Präsidenten des Reichspatentamts getroffen, gegen dessen Entscheidung keine Beschwerde möglich war. Organisation Zu Beginn seiner Tätigkeit gliederte sich das Patentamt in sechs Anmeldeabteilungen (für Patentanmeldungen) und eine Nichtigkeitsabteilung. Es gab keine eigenen Beschwerdeabteilungen, denn über Beschwerden gegen Beschlüsse einer Anmeldeabteilung entschied jeweils eine der anderen Anmeldeabteilungen. Das Patentgesetz von 1891 schuf erstmals die klare funktionelle Trennung von Anmelde-, Beschwerde- und Nichtigkeitsabteilungen sowie ein Vorprüfverfahren durch Mitglieder der Anmeldeabteilungen. Durch das Gebrauchsmustergesetz von 1891 wurde die Einrichtung einer Anmeldestelle für Gebrauchsmuster notwendig. Jedoch fand das Gebrauchsmusterlöschungsverfahren vor den ordentlichen Gerichten statt. Das Warenzeichengesetz von 1894 führte zur Errichtung von Warenzeichenabteilungen. Am 31. Oktober 1917 wurde das Patentamt aus dem Geschäftsbereich des Reichsamts des Innern ausgegliedert und dem Reichsjustizamt nachgeordnet. Am 24. März 1919 erhielt es die Bezeichnung "Reichspatentamt" (RPA). 1926 wurde beim Reichspatentamt der Große Senat gebildet, der die Entscheidungsbefugnis über grundsätzliche Rechtsfragen erhielt. Die Gesetze über den gewerblichen Rechtsschutz von 1936 bewirkten folgende organisatorische Veränderungen: Im Patentbereich wurden die Anmelde-, Beschwerde- und Nichtigkeitsabteilungen in Senate umbenannt, an deren Spitze Senatspräsidenten standen. Im Warenzeichenbereich gab es fortan Warenzeichenabteilungen und Beschwerdesenate. Im Gebrauchsmusterbereich ging die Zuständigkeit für Gebrauchsmusterlöschungsverfahren von den Zivilgerichten auf das Patentamt über. Daher gab es neben der Gebrauchsmusterstelle, die für Anmeldungen zuständig war, auch Gebrauchsmusterabteilungen, die mit Löschungen befasst waren. Durch eine Verordnung vom 17. Juni 1938 (RGBl. I S. 638) wurden das österreichische Patentamt und der österreichische Patentgerichtshof mit Wirkung vom 1. Juli 1938 übernommen und als Zweigstelle Österreich dem Reichspatentamt angegliedert. Die Zweigstelle wurde allerdings durch Erlass des Reichsjustizministers vom 23. Dezember 1941 (s. "Deutsche Justiz" 1942, S. 13) zum 31. März 1942 wieder aufgelöst (vgl. R 131/587-589, 794-796, 1021-1025). Im April 1945 stellte das Reichspatentamt seine Arbeit ein. Bedingt durch die Folgen des Zweiten Weltkrieges entwickelten sich in beiden deutschen Staaten separate Patentämter, in der Bundesrepublik Deutschland das Deutsche Patentamt (DPA) mit Sitz in München sowie einer Außenstelle in Berlin und in der Deutschen Demokratischen Republik das Amt für Erfindungs- und Patentwesen (AfEP). Personelle Entwicklung im Patentamt Bei der personellen Besetzung des Patentamts unterschied man neben dem Vorsitzenden, der seit der Bekanntmachung vom 26. Oktober 1882 den Titel "Präsident" führte, zwischen ständigen und nicht ständigen Mitgliedern sowie den "sonstigen" Bediensteten (Hilfskräften). Es gab zum einen rechtskundige, d.h. zum Richteramt oder zum höheren Verwaltungsdienst befähigte, zum anderen technische, d.h. in einem Bereich der Technik sachverständige, Mitglieder, die sämtlich in den Anfangsjahren des Patentamts nebenberuflich tätig waren. Im Jahr 1877 beschäftigte das Patentamt insgesamt 39 Personen. Im Zuge des Personalausbaus erhöhte sich zwar die Zahl der Beschäftigten von 39 (1877) auf 172 (1889), jedoch stieg die Mitgliederzahl nur von 22 auf 36. Der Grund dafür war das verstärkte Einstellen technischer Hilfsarbeiter (wissenschaftlicher Hilfskräfte). Als Folge der Neugestaltung durch das Patentgesetz von 1891, welches auch die Berufung der Mitglieder auf Lebenszeit brachte, wuchs der Personalbestand von über 600 (1900) auf annähernd 1.000 Personen (1914) an. Dabei vergrößerte sich die Zahl der Techniker im Vergleich zu den Juristen immer stärker. Im Ersten Weltkrieg wurden vermehrt weibliche Arbeitskräfte als Hilfskräfte eingestellt. Nach dem Krieg erreichte man den Stand von 1914 erst wieder im Jahr 1926 mit rund 1.000 Bediensteten. Ab 1930 setzte eine rasche Vergrößerung des Personalbestands ein, der seine Höchstzahl 1939 mit ca. 1.900 Personen erreichte. Internationale Zusammenarbeit: Auf internationaler Ebene kam es zur ersten Zusammenarbeit anlässlich der "Pariser Verbandsübereinkunft zum Schutz des gewerblichen Eigentums" vom 20. März 1883 (vgl. R 131/1049-1052, 1055). Dieser trat Deutschland allerdings erst mit Wirkung vom 1. März 1903 bei. Seitdem galt die Übereinkunft als innerdeutsches Recht. Ihre wichtigsten Bestimmungen waren die Unionspriorität und die Inländerbehandlung aller Unionsangehörigen. Diese Handhabung galt seit der Revision von 1911 auch für Gebrauchsmuster und Warenzeichen. Von besonderer Bedeutung ist außerdem das "Madrider Abkommen über die internationale Registrierung von Fabrik- und Handelsmarken" vom 14. April 1891 (vgl. R 131/1040, 1077-1081), dem Deutschland 1924 beitrat. Dies führte zur Bildung der Markenstelle für internationale Markenregistrierung beim Reichspatentamt. Bestandsbeschreibung: Bestandsgeschichte Wie andere Dienststellen der Verwaltung auch lagerte das in der Gitschiner Straße 97-103 in Berlin ansässige Reichspatentamt einen großen Teil seiner Unterlagen während des Zweiten Weltkriegs an Ausweichstandorte aus. Ab 1943 gelangten die Geheimsachen, das gesamte Prüfungsmaterial, die Akten der 21 Patentabteilungen sowie fast alle Unterlagen über noch schwebende Patentanmeldungen (ca. 180.000 Patenterteilungsakten der ersten Instanz) nach Schlesien, in ein leerstehendes Zuchthaus in Striegau und in den Ort Jauer. Die Geheimsachen über Patentanmeldungen, geheime Gebrauchsmuster, erteilte und Sonderpatente wurden im Januar 1945 wieder nach Berlin und im Februar 1945 in ein verlassenes Kalibergwerk in Heringen (Werra) gebracht. Dorthin verlegte man auch die Personalakten sowie einen Großteil der Bibliotheksbestände des Reichspatentamts (ca. 300.000 Bände) und das "Index" genannte Patentregister seit 1939 - mit Ausnahme des Buchstaben R, dessen Register in Striegau verblieb. Striegau wurde am 10. Februar 1945 von sowjetischen Truppen besetzt, die das Zuchthaus sprengten. Das gesamte Prüfungsmaterial, die Akten von 18 Patentabteilungen sowie das Patentregister für den Buchstaben R fielen den Flammen zum Opfer. Die nach der Rückeroberung der Stadt durch deutsche Truppen geborgenen Reste verbrachte man nach Heringen. Das Prüfungsmaterial und die Akten der drei restlichen Patentabteilungen, die zuvor in Jauer aufbewahrt worden waren, verlagerte man nach Eger und von dort aus später nach Lichtenfels. Andere Teile, vor allem Bücher und Prüfungsmaterial, flüchtete man im März 1945 von Striegau aus in eine Försterei in Bayerisch-Eisenstein. Diese Unterlagen überdauerten die Wirren der letzten Kriegstage. Das Schicksal der nach Jauer verlagerten Schriftgutbestände ist indes ungewiss. Von den in Berlin verbliebenen Unterlagen, v.a. Patenterteilungsakten der zweiten Instanz, d.h. Beschwerde- und Nichtigkeitsverfahren, sowie Akten über Gebrauchsmuster- und Warenzeichenverfahren, fielen große Teile den Kriegseinwirkungen in den letzten Monaten des Krieges zum Opfer. Durch Bomben zerstört wurden fast sämtliche Warenzeichenakten (ca. 520.000), Unterlagen über die in Deutschland geschützten, international registrierten Marken, fast sämtliche Gebrauchsmusterakten (ca. 160.000) sowie viele Verwaltungsakten. Vollständig zerstört wurden insbesondere die Sachakten der Personalverwaltung. Erhalten blieben vor allem die Patent-, Gebrauchsmuster- und Warenzeichen-Rollen. Von den sowjetischen Truppen wurden nach ihrem Einmarsch in Berlin am 27. Mai 1945 Patentanmeldungen, die sich im Beschwerdeverfahren befanden (ca. 2.787), Akten über erteilte Patente, von denen noch keine gedruckten Patentschriften vorlagen (ca. 150.000), eine Sammlung der deutschen Patentschriften (ca. 14.000 Bände), Teile der Büchereibestände über wichtige technische Probleme, sämtliche Dissertationen sowie ein Teil der Verwaltungsakten beschlagnahmt und teilweise weggeführt. Als nicht wichtig sah man offenbar die noch nicht bearbeiteten ca. 150.000 Patentanmeldungen an, da von diesen nur Durchschläge vorzufinden waren; die Originale waren in Striegau verbrannt. Die nicht von der UdSSR beschlagnahmten Unterlagen blieben in der Dienststelle Berlin, darunter auch Verwaltungsakten über Rechtssachen, das Patentanwaltswesen, Haushalts- und Kassensachen, und wurden später der Außenstelle Berlin des Deutschen Patentamts übergeben. Nicht mehr im laufenden Geschäftsbetrieb benötigte Unterlagen hatte das Reichspatentamt bereits ans Reichsarchiv auf dem Brauhausberg in Potsdam abgegeben. Dieser Schriftgutbestand wurde im April 1945 zerstört, als das Reichsarchiv nach Bombenabwürfen brannte. Nach dem Einmarsch der Westalliierten in Berlin fand sich die dortige Dienststelle des Reichspatentamts im US-amerikanisch besetzten Sektor der Stadt wieder. Von deren noch vorhandenen, unzerstört gebliebenen Unterlagen, darunter vor allem von den Patentanmeldungen, fertigte die amerikanische "Organization Field Information Agency Technical" (FIAT) Mikrofilme, die in die USA gebracht wurden. Das "British Intelligence Objective Sub-Committee" (BIOS) erstellte Auszüge aus den Patentakten, die in 22 Bänden zusammengefasst der Öffentlichkeit zugänglich gemacht wurden. Im Schacht Heringen hatten SD-Angehörige vor der Besetzung durch US-amerikanische Truppen wichtige Patente und Geheimakten (zu 95 Prozent) sowie Personalakten vernichtet. Ein großer Teil der dort verbliebenen Unterlagen, darunter ein Teil noch nicht bearbeiteter geheimer Anmeldungen und die geheime Patentrolle, wie auch der in Lichtenfels und in Bayerisch-Eisenstein sichergestellten Akten, wurde in die USA abtransportiert, unter anderem in das Aktendepot der US Army in Alexandria bei Washington. Das Patentamt erhielt im Juli 1945 die Erlaubnis, seine Tätigkeit wieder aufzunehmen. Als Amt für Bodenforschung wurde es mit Unterstützung der Regierung in Kassel an das Geologische Institut der Universität Marburg verlegt. Seine Akten lagerte man in der Grube Beilstein bei Oberscheld ein. Im Januar 1946 erfolgte die Abtrennung der für die Arbeit im großhessischen Raum benötigten von den die sowjetisch besetzten Gebiete betreffenden Unterlagen. Derart gelangte nach Beilstein das für die Provinzen Schleswig-Holstein, Hannover, Oldenburg, Braunschweig, Westfalen, das Rheinland und Süddeutschland relevante Material. Dem 1949 in München neu eröffneten Deutschen Patentamt übergaben die USA die Bibliothek des Reichspatentamts im Umfang von ca. 350.000 Bänden sowie Fotokopien beschlagnahmter Akten. Das in die USA verbrachte Schriftgut des Reichspatentamts wurde in den 1950er und 60er Jahren in die Bundesrepublik Deutschland zurückgeführt. Größtenteils gelangte das Schriftgut direkt ins Deutsche Patentamt nach München, darunter auch vor der Zerstörung im Schacht Heringen gerettete Personalakten. Die ehemalige Außenstelle des Reichspatentamts in Berlin nahm zu Anfang der 1950er Jahre ihre Arbeit offiziell wieder auf. Diese Treuhandstelle Reichspatentamt - Informationsamt für gewerbliche Schutzrechte wurde 1968 als Dienststelle Berlin in das Deutsche Patentamt übernommen. Die in Alexandria zur Record Group 1016 gehörigen Akten des Reichspatentamts (112 Kartons) wurden 1959 an das Bundesarchiv zurückgegeben, das sie im selben Jahr nach München abgab. Zu den von der Sowjetunion zurückbehaltenen Teilen der Überlieferung des Reichspatentamts gehören 132 Akten, die in den 1960er Jahren von der Geheimen Abteilung des Ministeriums für Landwirtschaft der UdSSR in das sog. "Sonderarchiv" überführt wurden. Diese ausschließlich das Fachgebiet Landwirtschaft betreffenden Akten erstrecken sich über die Laufzeit 1935-1942 und sind in einem russischsprachigen Findbuch erschlossen. Sie befinden sich noch heute in dem zur Aufbewahrung von "Beuteakten" bestimmten Archiv, das heute dem Russländischen Zentralen Staatlichen Militärarchiv untersteht (siehe www.sonderarchiv.de). Generalakten Die Generalakten des Reichspatentamts wurden von den Westalliierten direkt in das Deutsche Patentamt überführt. 1972 gab sie die Dienststelle Berlin des Patentamts an das Bundesarchiv ab (Zugang Nr. I 77/72). Patentanmeldungsakten Bis zum Kriegsende konnten nicht mehr alle Anmeldungen beim Reichspatentamt bearbeitet werden. Die Patentakten aus den Fällen, in denen wegen der Kriegsereignisse in den Jahren 1944-1945 kein Patent mehr erteilt werden konnte und die nicht bekannt gegeben worden waren, wurden zwischen 1945 und 1947 zusammen mit anderen Unterlagen technischer und wissenschaftlicher Art von zunächst militärischen, dann zivilen "Investigating Teams" der Briten und US-Amerikaner beschlagnahmt. Entscheidend für die Auswahl des Materials war das Interesse der britischen und US-amerikanischen Industrie an Fertigungsverfahren der deutschen Kriegswirtschaft. Fachleute beider Seiten arbeiteten anhand der Akten Forschungsberichte, sog. "Reports", über einzelne Firmen oder Produktionssparten sowie kurze Inhaltsbeschreibungen, sog. "Summaries", aus und machten diese der Öffentlichkeit zugänglich. Großbritannien veröffentlichte die "British Intelligence Objectives Sub-Committee Overall Reports" (BIOS) und die USA die "Field Information Agency Technical US Group, Control Council for Germany"-Serie (FIAT). Daneben wurde noch gemeinsam die "Combined Intelligence Objectives Sub-Committee"-Serie (CIOS) herausgegeben. Die Veröffentlichungen erregten ihrerzeit öffentliches Aufsehen. Der sog. Harmsen-Report übte Kritik an der "Ausbeutung" deutscher Patente seitens der USA und Großbritanniens. Auf britischer Seite war zunächst die "German Division" der "Technical Information and Document Unit" (TIDU) beim "Ministry of Economic Warfare" für diese Aktion zuständig. 1946 wurde die TIDU dem "Board of Trade" unterstellt. 1951 kam diese Informations- und Dokumentationsstelle in den Geschäftsbereich des "Department of Scientific and Industrial Research" (DSIR). Bei der Auflösung der TIDU 1957 übertrug man die Verwahrung des deutschen Aktenmaterials der "Lending Library Unit" des DSIR. Infolge Raummangels wurde diese 1961/62 als "National Lending Library for Science and Technology" nach Boston Spa, Yorkshire, verlegt. Die Originale der von den Briten ausgewerteten deutschen Patentakten befinden sich noch heute in Boston Spa. Zu Anfang der 1950er Jahre erwarb das Deutsche Patentamt in München Mikrofilme dieses Aktenbestands. Diese 1.000 Mikrofilmrollen kopierte das Bundesarchiv in den Jahren von 1969 bis 1974 auf Sicherheitsfilm um. Diese Filmduplikate bilden einen eigenen Teilbestand innerhalb von R 131. Sieben einzelne Patentakten gab das Deutsche Patentamt in München 1972 an das Bundesarchiv ab. Im Jahr 1975 wurden 243 sogenannte "Erteilungsakten" des Reichspatentamts mit der Genehmigung des Bundesarchivs in der Dienststelle Berlin des Deutschen Patentamts kassiert. Mehrere Kartons mit Patentanmeldungsunterlagen gelangten nach dem Zweiten Weltkrieg in die DDR, vermutlich in das Zentrale Staatsarchiv der DDR (ZStA) in Potsdam, wo sie zunächst wohl nicht weiter bearbeitet, d.h. auch nicht erschlossen wurden. In Ermangelung entsprechender Dokumentation lässt sich der Zeitpunkt, zu dem diese Unterlagen nach Deutschland kamen, nicht näher bestimmen. Russischsprachige Vermerke auf einzelnen Dokumenten lassen immerhin darauf schließen, dass diese Unterlagen 1945 von den sowjetischen Besatzungstruppen beschlagnahmt und von Fachleuten gesichtet, vermutlich auch ausgewertet wurden. Ob sie im Zuge der sowjetischen Aktenrückgaben in den 1950er Jahren oder zu einem anderen Zeitpunkt nach Deutschland zurückkehrten, ließ sich bisher leider genauso wenig feststellen. Nach der Integration der zentralen Archive der DDR ins Bundesarchiv 1990 wurden diese Unterlagen jedenfalls in die neue Außenstelle des Archivs in Hoppegarten umgelagert. Dort blieben sie bis 2010, als das Archiv Aufräumarbeiten durchführte, weitgehend unbeachtet. Vergeltungsakten Eine wenig umfangreiche Überlieferung an Vergeltungsakten (ca. 420 AE) gelangte im April 1973 durch eine Abgabe (Zugang I 26/73) der Dienststelle Berlin des Deutschen Patentamts ins Bundesarchiv. Personalakten Das Deutsche Patentamt gab im Jahr 1980 aus seiner Dienststelle in München Personalakten von Beamten des Reichspatentamts ab, die nach dem Krieg noch weiterbeschäftigt worden waren. Die in München gelagerten Akten waren infolge eines Brandschadens bei der zu Kriegsende erfolgten Auslagerung, von wenigen Ausnahmen abgesehen, zu großen Teilen angesengt bzw. vollständig verbrannt. Die Dienststelle München gab im selben Jahr 1980 ferner "Personalakten verschiedener Behörden und Gerichte über Personen, deren Zugehörigkeit zum ehemaligen Kaiserlichen Patentamt/Reichspatentamt nicht festgestellt werden konnte", ab. Aus seiner Dienststelle in Berlin gab das Deutsche Patentamt 1980 in dreizehn Kartons 859 Personalakten von Angehörigen des Kaiserlichen bzw. des Reichspatentamts ab. Das Bundesministerium der Justiz (BMJ) als vorgesetzte Dienststelle des Bundespatentamts reichte 1980 im Nachgang eine weitere Archivalieneinheit nach (R 131/2720). Aus den für archivwürdig befundenen Akten wurde im Bundesarchiv der Teilbestand "R 131 - Personalakten" gebildet (Signaturen: R 131/1698-2720). 1981 gab das BMJ weitere 29 Personalakten des Reichspatentamts ab, die dem Bestand beigefügt wurden (R 131/2730-2758). 1995 wurden dem Bundesarchiv vom Deutschen Patentamt, München, 94 Personalakten jüdischer Patentanwälte übergeben (R 131/2760-2853). Im März 2004 gab das Bundespatentamt sechs Kartons mit 325 Personalakten von Patentanwälten an das Bundesarchiv ab. Im April desselben Jahres folgten weitere 194 Akten, im Juli drei weitere Kartons. Spätere Nachlieferungen sind nicht im Einzelnen dokumentiert, auch fehlen weitere Abgabeverzeichnisse oder namentliche Auflistungen. Insgesamt handelt es sich um ca. 19 lfm (38 große Umzugskartons). Aus dem Bestand 30.12 (Reichsjustizprüfungsamt) des Zentralen Staatsarchivs der DDR in Potsdam wurden 0,57 lfm (3 Archivkartons) mit Fragmenten von Personalakten in den Bestand übernommen (Altsignaturen: 30.12/2296-2895). Diese Unterlagen sind noch unbearbeitet wie auch weitere 0,14 lfm (ein Archivkarton) an Fragmenten von Personalunterlagen unbekannter Herkunft. Archivische Bewertung und Bearbeitung Das Schriftgut des Reichspatentamts bildet im Bundesarchiv den Bestand R 131. Für die unterschiedlichen Überlieferungsteile wurden in den 1980er Jahren zunächst jeweils eigenständige Findmittel angefertigt: R 131 - Generalakten R 131 - Vergeltungsakten R 131 - Patentanmeldungsakten R 131 - Personalakten In späteren Jahren kamen weitere Personal- und Patentanmeldungsakten hinzu. Organisationsunterlagen und Aktenpläne des Reichspatentamts sind nicht vorhanden. Lediglich ein Aktenplan von 1935/36 (vgl. R 131/446) konnte ermittelt werden, der in Anlehnung an den Generalaktenplan des Reichsjustizministeriums nach Haupt- und Untergruppen gegliedert, allem Anschein nach aber nie in Kraft getreten ist. Das Fehlen von Aktenplänen bzw. von entsprechend aufschlussreichen sonstigen Nachweisen über die Registraturführung im Reichspatentamt einerseits und das Vorhandensein zahlreicher Akten ohne Aktenzeichen andererseits lassen definitive Aussagen über die Schriftgutverwaltung der Behörde und eine durchweg induktive Klassifikation nicht zu. Generalakten Die Aktenverwaltung oblag den einzelnen Registraturen des Reichspatentamts. Vermutlich führten diese - nach dem Muster der Justiz - jeweils Generalaktenregister, in welche die dort gebildeten Generalakten eingetragen und anhand derer neue Aktenzeichen für neu anfallende Akten vergeben wurden. Es ist auch zu vermuten, dass in einer der Registraturen oder Organisationseinheiten des Hauses ein "vollständiges" Generalaktenregister geführt worden ist. Die Vergabe von Aktenzeichen erfolgte offenbar nach Aufgabenbereichen, gekennzeichnet durch römische Ziffern, so z.B. "gen. I" für Patentsachen. Auf der Aktenstufe vergab man arabische Ziffern, so z.B. "gen. I, 1". In einigen Fällen erfolgte eine weitere Untergliederung des Aktenstoffs durch Anfügen von Kleinbuchstaben an die Grundnummer, so z.B. "gen. III, 4 - Zeichen" "gen. III, 4 a - Freizeichen" "gen. III, 4 b - Wortzeichen" "gen. III, 4 c - Wappen". Zahlreichen Generalakten sind Rotuli vorgeheftet, in denen die Schriftstücke vorgangsweise nachgewiesen sind. Nach klassischem Muster wurden im Reichspatentamt zu den Generalakten auch abgeleitete Akten in Form von Specialia und Adhibenda angelegt: Die Kennzeichnung erfolgte durch die bekannten Abkürzungen "spec." und "adh.". Die Gliederung des Aktenstoffes in diese Aktenkategorien scheint dem Wortsinn nach fast durchweg logisch durchgeführt worden zu sein. Eine erste Bearbeitung der Generalakten nahmen in den Jahren 1984-1985 Dorothe Günthner und Johannes Ganser vor. Bei der Verzeichnung der Akten wurden nicht nur sämtliche Aktenzeichen aufgenommen worden, sondern auch auf den Aktendeckeln angebrachte Hinweise auf verwandte Aktenzeichen, allerdings nur insoweit, als letztere im Bundesarchiv überliefert sind. Der Umstand, dass die Überlieferung des Schriftguts des Reichspatentamts, darunter auch jenes der Generalakten, nur unvollständig in das Bundesarchiv gelangt ist; ist an der Klassifikation deutlich sichtbar. Die Klassifikation des Bestands konnte nach der vom Reichspatentamt vorgenommenen Gruppierung der Akten nach Aufgabenbereichen (römische Ziffern) und Aktennummern (arabische Ziffern) in aufsteigender Zahlenfolge vorgenommen werden, ausgenommen die ohne Aktenzeichen überlieferten Akten zu den Patentanwälten, die als Gruppe VI angefügt wurden. Die Gesamtklassifikation stellt sich folgendermaßen dar: I Patente II Geschmacks- und Gebrauchsmuster III Warenzeichen IV Angelegenheiten von Hauptbüro/Präsidialabteilung V Gewerblicher Rechtsschutz im Ausland VI Patentanwälte. Die Klassifizierung der Gruppen I-III und V gestaltete sich dank vorgegebener Aktenzeichen bei der Mehrzahl der Akten nach diesem Raster problemlos. Die ohne Aktenzeichen vorliegenden Akten in den Gruppen I-III konnten relativ leicht nach sachlichem Zusammenhang zugeordnet werden. Eine tiefer gestufte Klassifikation erschien nicht erforderlich. In den Gruppen I-III waren die Akten-Nummern ursprünglich wohl so vergeben worden, dass sie den jeweiligen Paragrafen der Patent-, Muster- und Warenzeichengesetze entsprachen. Für diejenigen Akten, die nicht in unmittelbarem Bezug zu Gesetzesparagrafen standen, sind die Aktenzeichen offenbar in fortlaufender nummerischer Abfolge vergeben worden. Die Gruppe IV hebt sich gegenüber den übrigen Gruppen insofern ab, als es sich um den schriftlichen Niederschlag übergreifender Tätigkeiten des Hauptbüros bzw. der Präsidialabteilung handelt: Regelungen zur Handhabung der Bestimmungen des Patent-, Gebrauchs- und Geschmacksmuster- sowie des Warenzeichenrechts einerseits sowie Regelungen des Dienstbetriebs, Geschäftsgangs, Postverkehrs andererseits. Hier ist - auf Grund der unvollständigen Überlieferung der Akten - eine Aktenordnung ähnlich jener der Gruppen I-III nicht erkennbar. Wegen der lückenhaften Überlieferung des Bestands einerseits und fehlender Aktenzeichen andererseits - meist sind nur Spezialia oder Adhibenda vorhanden, während die Generalia fehlen -, wurde bei der Klassifikation zwar die Abfolge der Aktenzeichen beibehalten, aber im Unterschied zu den Gruppen I-III und V eine archivische Klassifikation durchgeführt, die eine feiner gestufte Gliederung notwendig machte. Die Akten der Gruppe V sind vom Reichspatentamt nach einem Länderalfabet angelegt, die Aktenzeichen auch hier in aufsteigender Zahlenfolge vergeben worden. Die Reihung der Akten nach Aktenzeichen wurde bei der Klassifikation lediglich dadurch unterbrochen, dass die Akten betreffend internationale Zusammenschlüsse, Abkommen und Kongresse, die mitten in der Länderserie angesiedelt worden waren, dort herausgenommen und an den Schluss der Aktengruppe gestellt wurden. Angesichts im Laufe der Jahrzehnte geänderter Bezeichnungen einzelner Staatsgebiete (vgl. z.B. Schutzgebiete) ist zur Erleichterung der Benutzung ein geografischer Index gefertigt worden. Die ohne Aktenzeichen überlieferten Akten der Gruppe VI wurden nach Sachkomplexen klassifiziert. Kassiert wurden im Jahr 1995 die in den Generalakten enthaltenen und Auszüge aus Gesetzes- und Veröffentlichungsblättern sowie bedeutungsloser Schriftwechsel - z.B. über die Verlegung von Sitzungen des Reichspatentamts. Das von Dorothe Günthner und Johannes Ganser erarbeitete Findbuch wurde von Frau Schuster geschrieben. Diese Erschließungsdaten wurden nach 2005 retrokonvertiert und können nunmehr im Datenbanksystem des Bundesarchivs (BASYS) über das Recherchesystem INVENIO abgerufen werden. Vergeltungsakten Dorothe Günthner und Johannes Ganser bearbeiteten im April 1984 den ersten Teil der Überlieferung. Von den ursprünglich 376 Bänden (ca. 1,5 Gefach) des ersten Überlieferungsteils wurden 75 Bände als archivwürdig bewertet (R 131/10001-10076). Kassiert wurden insbesondere diejenigen Akten, die aus rein formalen Gründen abgelehnte Anträge nach der Verordnung über die Behandlung feindlichen Vermögens vom 15. Januar 1940 (RGBl I S.191) zum Gegenstand haben. Bei Aktengruppen, welche die Bearbeitung von Anträgen einer bestimmten Firma auf die Nutzung von mehreren Patentrechten dokumentieren, die eine andere Firma innehatte, wurde, da ursprünglich für jedes Patent ein einzelner Band angelegt worden war, jeweils nur ein Beispielband aufgehoben. Im 1984 entstandenen Findbuch erschlossen wurden der Name des Antragstellers, des Schutzrechtinhabers, die Laufzeit sowie die alten Vergeltungsaktenzeichen. Auf die Nennung der einzelnen Schutzrechtinhalte wurde verzichtet, da sie hinter dem Aspekt der kriegswirtschaftlichen Maßnahmen des Deutschen Reiches in heutiger Bewertung zurück stehen. Die vorgegebene Gliederung in Akten über erteilte und nicht erteilte Ausübungsrechte wurde beibehalten. Diese beiden Gruppen waren wiederum unterteilt in Patente, Gebrauchsmuster, Warenzeichen, Urheberrechte und Patente in einzelnen eingegliederten Gebieten. In der zweiten Jahreshälfte 2008 wurde der Bestand einer Revision unterzogen, da Unstimmigkeiten im Signaturensystem aufgetaucht waren. 270 Archivalieneinheiten, die bei Bestandsbereinigungen aufgefunden worden waren, wurden neu verzeichnet (R 131/10077-10346). Der gesamte Überlieferungsteil "Vergeltungsakten", der nun insgesamt 345 AE umfasst, wurde eingemappt und vollständig neu signiert. Kassationen wurden nicht vorgenommen. Die Erschließung folgte den Vorgaben des Findbuchs von 1984. Erfasst wurden entsprechend die Namen der Antragsteller, der Schutzrechtinhaber, die Laufzeiten sowie die Aktenzeichen der Vergeltungspatente. Die Verzeichnungsdaten zum ersten Überlieferungsteil wurden per Retrokonversion in die Datenbank des Bundesarchivs (BASYS) übertragen. Bei der Integration der neu hinzugekommenen Unterlagen konnte das bereits vorgegebene Klassifikationsschema beibehalten werden. Das nun vorliegende, von Karl-Heinz Eggert und Sabine Dumschat bearbeitete Findbuch ist auch online recherchierbar. Patentanmeldungsakten Patent- und Gebrauchsmusteranmeldungen wurden im Reichspatentamt bestimmten Klassen zugeordnet. Zu diesem Zweck bestand dort eine nach gewerblichen und industriellen Spezialfachgebieten gegliederte Patentklasseneinteilung. Sie diente als Grundlage für die Bearbeitung der Anmeldungen. Der wichtigste Grundsatz für die Bestimmung der Klassenzugehörigkeit einer Anmeldung war deren Zuweisung in dasjenige Spezialfachgebiet, in dem die Erfindung lag. Zur Feststellung der Erfindung musste der Prüfer alle eingereichten Unterlagen, d.h. Beschreibung, Zeichnung, Ansprüche, heranziehen. Falls mehrere Spezialgebiete vorlagen, fiel die Entscheidung auf die am wichtigsten erscheinende Klasse. Zu den Mikrofilmen jener Akten, die sich bis heute in britischem Gewahrsam, in der "National Lending Library for Science and Technology" in Boston Spa befinden, erstellte 1984 Johannes Ganser ein Findbuch, das im Benutzersaal des Bundesarchivs für Recherchen zur Verfügung steht. Die Grundlage der Gliederung des Teilbestands bildet die beim Reichspatentamt praktizierte Patentklasseneinteilung. Diese war für die Briten bei der Verfilmung der Akten indes nicht der entscheidende Klassifikationsmaßstab. Anmeldungen zu einer bestimmten Klasse können somit auf mehreren Filmen zu finden sein; auf jedem Film sind vice versa Unterlagen zu mehreren Patentklassen zu erwarten. Bei der Benutzung der Filme ist demnach zunächst von dem in Frage kommenden Spezialfachgebiet gemäß der Patentklasseneinteilung auszugehen. Auf welchen Filmrollen zum entsprechenden Fachgebiet Unterlagen vorhanden sind, ist der 1. Konkordanz im Findbuch zu entnehmen. Die 2. Konkordanz stellt die Verknüpfung zwischen den Rollensignaturen und den Filmsignaturen her. Die über das Zentrale Staatsarchiv der DDR überlieferten Einzelfall-Unterlagen wurden im Zeitraum 2011-2012 bearbeitet. Sie befanden sich zunächst in einem ungeordneten, um nicht zu sagen: chaotischen Zustand. Es ist davon auszugehen, dass der Kontext einstmals organisch gewachsener Einzelvorgänge empfindlich gestört ist. Begleitende Dokumentation irgendwelcher Art konnte nicht ermittelt werden. Die Unterlagen waren stoßweise in Papier eingeschlagen und mit Paketband verknotet. Diese Bündel wurden geöffnet, die Unterlagen vollständig durchsortiert. Da kein Überlieferungskontext, geschweige denn ein System der Aktenbildung zu erkennen war, wurde versucht, vermittels alfabetischer Sortierung nach Patent-Anmeldern Abhilfe zu schaffen. Anschließend wurden 314 Archivalieneinheiten gebildet, neu eingemappt und signiert (R 131/10347-10670). Doppelstücke wurden vernichtet, darüber hinaus jedoch keine Kassationen vorgenommen. Eine Akte (R 131/10502) wurde an das Bergbauarchiv im Deutschen Bergbau-Museum, Bochum, abgegeben. Ein "Nachtrag zur Nummernliste" für das Jahr 1933 ist nunmehr in der Dienstbibliothek des Bundesarchivs zugänglich (Signatur: ZB 24128). Sowohl die Klassifikation des Bestands als auch die Erschließungsparameter orientieren sich an dem Muster, welches das Findbuch für die Vergeltungsakten aus dem Jahr 1984 vorgegeben hat. Unterschieden wurden die Anmeldung von Patenten und Gebrauchsmustern, ungültige Patente und Hilfsmittel in Form von Unterlagen, welche die Zulassungen ausländischer Patentämter dokumentieren. Unterschieden wurde nach Anmeldern, die im Deutschen Reich ansässig waren, und solchen, die vom Ausland aus ihre Ansprüche geltend zu machen versuchten. Bei letzteren handelt es sich unter anderem um Dependancen deutscher Konzerne im Ausland. Im Einzelnen erfasst wurden bei der Erschließung jeweils: Namen der anmeldenden Firmen oder privaten Antragsteller bzw. der Patentinhaber, schlagwortartig der Patentanspruch, d.h. der Gegenstand des Patents respektive das zu schützende Verfahren, das Aktenzeichen des Reichspatentamts, gegebenenfalls auch die zugeteilte Patentnummer sowie die Laufzeiten der Akten. Das nun vorliegende, von Karl-Heinz Eggert und Sabine Dumschat bearbeitete Findbuch ist auch online recherchierbar. Personalakten Von den vom Deutschen Patentamt 1980 aus seiner Dienststelle in München abgegebenen Personalakten von Beamten des Reichspatentamts, die nach dem Krieg noch weiterbeschäftigt worden waren, wurden nur zwei als archivwürdig angesehen. Der Rest wurde kassiert. Die in den Bestand R 131 integrierten Akten sind vorläufig personenbezogen erschlossen (sog. "Anlage 2"). Bei allen im selben Jahr 1980 abgegebenen "Personalakten verschiedener Behörden und Gerichte über Personen, deren Zugehörigkeit zum ehemaligen Kaiserlichen Patentamt/Reichspatentamt nicht festgestellt werden konnte", handelte es sich bei näherer Prüfung um Vorakten des Reichspatentamts. Die Mehrzahl der Akten wurde für kassabel befunden (untergeordnetes Büropersonal). Lediglich 14 Akten wurden in den Bestand übernommen: R 131/1737, 1754, 1787, 1804, 1942-1943, 1996, 2609, 2000, 2000 a, 2000 b und 2721-2723. Sie sind in einem Vorläufigen Verzeichnis personenbezogen erfasst (sog. "Anlage 3"). Mit den aus seiner Dienststelle in Berlin 1980 in 13 Kartons übergebenen 859 Personalakten von Angehörigen des Kaiserlichen bzw. des Reichspatentamts lieferte das Deutsche Patentamt ebenfalls ein Vorläufiges Verzeichnis mit namentlicher Auflistung (sog. "Anlage 4") ab. Abgesehen von den Akten R 131/2724, 2725 und 2726 waren diese Unterlagen stark zerstört und kassabel. Zu den "bei der Dienststelle Berlin des Deutschen Patentamts befindlichen Personalakten oder Personalaktenteile[n] über Angehörige des ehemaligen Kaiserlichen Patentamts und des Reichspatentamts" existiert allerdings noch eine zweite, leider undatierte, namentliche Aufstellung mit 875 Einzelpositionen, die sich mit der oben genannten nicht deckt. Eine eindeutige Klärung kann erst die Erschließung aller noch nicht in BASYS erfassten archivwürdigen Personalakten ergeben. Aus den nach der Bewertung verbliebenen Akten wurde im Bundesarchiv der Teilbestand "R 131 - Personalakten" gebildet (Signaturen: R 131/1698-2720). 1981 kamen die vom Bundesministerium der Justiz abgelieferten 29 Personalakten des Reichspatentamts hinzu, zu denen gleichfalls ein Vorläufiges Verzeichnis vorhanden ist (R 131/2730-2758). Eine namentliche Auflistung existiert ebenso zu den 1995 vom Deutschen Patentamt abgegebenen 94 Personalakten jüdischer Patentanwälte (R 131/2760-2853). Von den im Jahre 2004 vom Deutschen Patentamt abgegebenen Personalakten, v.a. von Patentanwälten, liegen bisher lediglich zu 519 namentliche Auflistungen vor. Eine Bewertung der 38 große Umzugskartons umfassenden Ablieferungen steht noch aus. Ebenso müssen die aus dem Bestand 30.12 (Reichsjustizprüfungsamt) des Zentralen Staatsarchivs der DDR in Potsdam aussortierten Fragmente von Personalakten sowie die weiteren 0,14 lfm (ein Archivkarton) Personalunterlagen unbekannter Herkunft noch bearbeitet werden. Inhaltliche Charakterisierung: Inhaltliche Charakterisierung Generalakten Der Generalaktenbestand gibt einen Einblick in die Tätigkeit des Reichspatentamts, der von erheblichem Wert für die Geschichte der Technik und die Entwicklung des Rechtswesens, insbesondere des gewerblichen Rechtsschutzes in Deutschland, sein dürfte. Hervorhebenswert sind die umfangreiche Sammlung von Gesetzen und Verordnungen zum gewerblichen Rechtsschutz im Ausland sowie die Akten aus der Mitarbeit des Reichspatentamts in der Internationalen Union zum Schutz des gewerblichen Eigentums. Diese Mitarbeit hatte auch das Ziel, die internationalen Abkommen mit den deutschen Gesetzen auf diesem Gebiet zu koordinieren. Nach 1945 hatte das Reichspatentamt noch partiell weiter gearbeitet, was die Fortführung einiger Akten bis 1951 erklärt. Februar 1940 (RGBl I S. 424), der Verordnung über Urheberrechte britischer Staatsangehöriger vom 1. Juli 1940 (RGBl I S. 947) sowie der Verordnung über gewerbliche Schutzrechte und Urheberrechte von Angehörigen der Vereinigten Staaten von Amerika vom 22. Dezember 1942 (RGBl I S. 737). Die für archivwürdig befundenen Vergeltungsakten besitzen somit einen gewissen Aussagewert über das Verhältnis Deutschlands zu den USA und Großbritannien, wenn auch beschränkt auf den gewerblichen Rechtsschutz während des Zweiten Weltkriegs. Darüber hinaus ist zu erkennen, auf welchen Gebieten Erfindungen als kriegswichtig und als zur Wahrung allgemeiner Belange notwendig angesehen wurden. Die in den Jahren 2008-2010 nacherschlossenen Unterlagen behandeln vor allem deutsche Reichspatente, die Urheberrechte für künstlerische Werke, deutsche Warenzeichen und österreichische Marken. Sie erstrecken sich über den Zeitraum 1941-1945. Bearbeitungsvermerke oder Schreiben des Reichspatentamts sind selten vorhanden. Lediglich Hinweise auf Druckschriften, die zur Abgrenzung des Anmeldungsgegenstands in Betracht gezogen wurden, tauchen hin und wieder auf. Diese Unterlagen stammen aus Verfahren, die wegen des Kriegsgeschehens nicht zu Ende geführt werden konnten, zu denen keine Patente mehr erteilt wurden. Dennoch geben sie einen Einblick in die Anstrengungen und Errungenschaften deutscher Erfinder und Unternehmen in der Spätphase des Zweiten Weltkriegs. Man erkennt teilweise, welche gewerblichen und industriellen Zweige infolge der kriegsbedingten Probleme zurückgestellt werden mussten. Der technikgeschichtliche Wert der Unterlagen dürfte nicht unerheblich sein. Überlieferung: Patentanmeldeakten 1941-1945 (999 Mikrofilme) Findmittel: Findbuch (1984) b) Die über das Zentrale Staatsarchiv der DDR überlieferten Unterlagen beziehen sich vornehmlich auf Erfindungen, die mit dem Wirtschaftsbereich des Bergbaus zu tun haben. Es handelt sich um in ihrer Struktur gleichförmige Einzelfall-Vorgänge, denen in der Regel allerdings die Anlagen abhanden gekommen sind, die zur Erteilung von Patenten herangezogen werden mussten. Ein Teil dieser Anlagen sind vermutlich die als "Hilfsmittel" verzeichneten fremdsprachigen Unterlagen. Da die registraturmäßige Ordnung dieses Überlieferungsteils vollkommen zerstört vorgefunden wurde und die verbliebenen Unterlagen zu wenige Geschäftsgangsvermerke tragen, war eine Rekonstruktion der ursprünglichen Vorgänge leider nicht möglich. Description of holdings: Abt. 40 Gemeindearchiv Herrnsheim (before 1945) Scope: 307 archive cartons 2 lfm Amtsbücher (= 2538 units = 49 lfm) Duration: 1445 - 1945 The preface to the present holdings Abt. 40 - Gemeindearchiv Herrnsheim (bis 1945) - des Stadtarchivs Worms is intended to give a brief insight into the development of the registry and archive material on the one hand at the time of its safekeeping in the Bürgermeistei Herrnsheim, and on the other hand since its takeover by the city of Worms. Subsequently, the indexing work is explained, with reference to special features and supplementary holdings. A short outline of the local history is sent in advance in the wording of the inventory overview of the Stadtar-chiv Worms, literature references to deepen the information on the local history can be found as an appendix to this foreword. I. II. municipal registry and archive In 1826, in accordance with the government decree of 25.7.1826, a register of the collections of laws, ordinances and instructions available in the Herrnsheim archive was compiled. The archive was refurbished in 1830/31 in connection with the construction of the new community centre. New furniture was commissioned and manufactured, including a filing cabinet for the archive and another for the mayor's office. Also the receipt of the Wwe. Ph. Ch. Schöneck from Worms of 20.4.1831 about 12 guilders and 19 cruisers for the repair of 28 steep cartons for the Bürgermeisterei-Archiv in Herrnsheim gives an insight into the file storage in Herrnsheim. On 30 October 1830, a circular was sent to all the provincial mayor's offices concerning the management of the files, concerning the "Order of the Provincial Municipal Archives". It is demanded that the official documents be sorted according to the aforementioned headings, that the files be sorted chronologically according to objects until 1830, then stored in cardboard boxes or cupboards in closed premises. The latter requirements were met - as explained above - in the new furnishing of the community centre. According to the circular, all receipts should be attached and the collection completed by 1 February of each year. On 27 March 1838 Mr. Völcker was commissioned by the district council to revise the municipal registry in Herrnsheim. In accordance with the registration plan for the mayors, he should inspect and arrange the documents on site and only receive his fees if he has completed this work in accordance with the regulations. Obviously this was not the case, because on July 26, 1838 the county council of Staedel assigned Mr. Peth from Bermersheim with the order of the municipal registry in Herrnsheim. A further inventory, which now also includes the files, was created for the community of Herrnsheim - presumably between 1905 and 1910 for valuation for insurance purposes. In the care of the mayor were an archive cabinet, two large file cabinets, a small file cabinet and an old file box. In addition to official and legal gazettes, various ordinances, handbooks and technical literature, 56 fascicles, the value of which could not be determined, are listed for the registry plan groups I - XXVI. In the following, numerous fascicles are listed both with details regarding assignment to the registry plan, duration and evaluation. Particularly noteworthy are e.g. the fair protocol book of 1716, guardianship bills and wills etc. 1699-1821, official and court protocols 1778-1798, fire register 1817, 1835 and 1848 as well as a new one. Also a local building plan (3 sheets), which is no longer available after current distortion, is proven in this inventory, estimated at 200 Marks. It should also be noted that there were several murals in the town hall, the Duke Dalberg, Emperor Wilhelm I, Emperor Wilhelm II and the Empress as well as members of the hess. Grand Duke's family, there were also other pictures, one, the volcanic eruptions showed another, the battlefield around Metz. The files mentioned in this inventory, which the registrar kept, seem to be available except for the volume listed here Birth, marriage and death registers 1780-1798. The next overview of the municipal archive Herrnsheim is provided in 1937 by Prof. Dr. Wilhelm Becker with his compilation of the inventories of the municipal archives of the district Worms. Here Prof. Henkelmann from Bensheim checked the existence of the community Herrnsheim and according to the file groups of the hess. The registry plan of 1908 is summarized. It should be noted that the oldest pieces mentioned here, e.g. the Morgenbuch (1626-1666; Dept. 40 No. 370), the Verordnungsbuch des Franz Heinrich Käm-merer von Worms Frhr. v. Dalberg (from 1742; Dept. 40 No. 1), the instrument of those at Neuhau-sen, about the provision of two Geharnischter at Herrnsheim (1445, no. 5), baker's order of 1736 (copy, dept. 40 no. 371) as well as further pieces already listed above in the inventory at the beginning of the 20th century, e.g. the fair protocol book, official and court records. In October 1914, the decree book of Franz Heinrich Kämmerer v. Dalberg as well as the instrument of those of Neuhausen were made available for use by the Grand Ducal Hessian House and State Archive in Darmstadt on behalf of the former Referendar Müller. Note: It is noticeable that the municipal council minutes are not available as a complete series, the earliest protocol book even only in 1836 begins. It is to be assumed and in comparison to other church archives as unusual to notice that this volume was at all the first protocol volume for Herrnsheim. It was acquired on 3 May 1836 alongside various other registers. According to the inventory (see above) three volumes were available at the beginning of the 20th century (1836/40, 1856/75 and 1875 ff), the pieces were valued at 90 marks. At least for the absence of a ribbon an explanation could be found in the files. The former mayor Brandt refused the publication of the protocol book in 1856. In 1986, the city archives once again attempted to investigate the failure of the municipal council records between 1840 and 1919, but the then head of the town Josef Wolf had to fit as well. There is also a gap in the series of municipal accounts with the corresponding volumes of deeds between 1924 and 1940. For the years after 1940, the accounts as well as the accounts and the corresponding documents of the Geschwister-Zimmer-Siftung for the period between 1921 and 1941/42 are missing. The loss of some files or the one or the other transaction can be explained by the fact that it happened that these were lost during the loan e.g. to the district office in Worms. For this reason, Herrnsheim refused to hand over correspondence with Freiherr Heyl'schen Güterverwaltung concerning the question of space for the fire station of the fire brigade to the Hessian Building Department in Worms. On his cover letter it was noted: did not happen, otherwise the files (like so many before already) would not be findable any more one day. In order to prevent the loss or destruction of files by air raids, Martin Fell and his wife were requested by the local administration on 21.9.1942 to secure important documents every evening and to salvage the files in the event of damage to the town hall caused by air raids. On 29.4.1943, in the course of the incorporation of Herrnsheim, the files were first transferred to the cellar of the Cornelianum in Worms. On the basis of the different file aprons the different used Regist-raturplans can be recognized, first 1836, then 1908 and finally after 1942 (with the inscription 'Stadtverwal-tung Worms'). Some file covers were preserved as samples in abbot 40 no. 2532 - no. 2534). For the fascicles belonging to the classification group XXI.09. Dalbergische Grundstücksangelegenheiten, the file aprons have inscriptions similar to those shown for files in Dept. 159. III. listing The written material taken over in the course of the incorporation 1943 was registered in the 70iger years after the Bär'schen principle, whereby as a rule the titles of the office books and minutes as well as those after the hess. file plans from 1836 or 1908 on the file aprons were taken over traditional inscriptions. This first registration work originally comprised 371 units, whereby the last registered units (from no. 331) were supplemented at later dates and comprised a running time until 1966. On 24 June 1971, the then District Court Director Dr. Heinz Pfannebecker handed over 12 documents to the City Archives, which obviously originated from the provenance of the Herrnsheim Mayor's Office. Most recently, in 2002, title recordings of sources from the still unlisted partial stock were made in connection with Volker Brecher's work on the war economy in Worms. Here, files were taken into account that were thematically related to prisoners of war, foreigners, etc. for the period between 1938 and 1950. In the inventory of Dept. 40, which had already been recorded, a few files exclusively with the term after 1945 were taken into account in the first registration. These were segregated and returned with the still unlisted part of the stock, which also included files after 1945, in order to be processed later in connection with Dept. 6 Municipality of Worms (after 1945). Since individual files may have already been used under their old signature, a list of these pieces can be found in the appendix of this finding aid book, which is currently stored in 29 archive boxes (plus some loose pieces) in the magazine of the Raschi-Haus (Regal 25) together with the total of six linear metres of written material after 1945. With the new indexing of the inventory Abt. 40 - Gemeindearchiv Herrnsheim - was started in December 2005, the indexing work was completed in July 2006. In addition to the written material already listed, unlisted material was also taken into account. The indexing work was carried out according to the Bär principle, whereby a new numbering inevitably resulted with the dissolution of earlier larger indexing units, i.e. new signatures were assigned for these documents. Therefore a concordance between old and new signatures was created and attached to this find book. The entire inventory was entered into the AUGIAS archiving program and simultaneously indexed (company, location, person and subject index). The basis for the classification was the hess. The file plan of 1908 was chosen and modified and supplemented according to local needs. For reasons of data protection, approx. 140 files were provided with blocking notices for use. The relatively high number results from the fact that a large number of civil documents are available for which the Civil Status Act provides guidelines for use or non-use. Thin folders from the period around 1930/40 were collected, which contained Generalia - often only in the size of 2-3 sheets - and had no direct reference to matters in Herrnsheim; in addition, two bundles of calibration maps were sorted out, which have no informative value whatsoever. In total, the scope of the cassation covers three archive boxes. The municipal archive Herrnsheim is kept to the extent of 2538 units of description (numerically up to 2534) in 308 archive boxes (49 linear metres, of which 2 linear metres are official books). The duration ranges from 1445 to the 1970s, with a focus on the 19th century and the first half of the 20th century. Despite incorporation in 1942, the cut for the index was set at 1945 so that two border data did not have to be taken into account within only three years, i.e. 1942 as the year of incorporation on the one hand, 1945 as the border year for the files handed down by the city administration before 1945 (Dept. 5) and after 1945 (Dept. 6) on the other. Therefore, the files were left in Dept. 40, in which at least one document from 1945 was still contained - irrespective of whether the temporal focus of the file tended to concern the period after 1945. IV. State of preservation The state of preservation of the files and official records of the present municipal archives can be described as good by and large. Unfortunately a larger number of pieces affected with mould is to be registered in particular under the calculations and documents, as well as the handbooks and diaries over incomes and expenditures: 45 with light mould infestation, with mould and water damages 7 pieces and 14 volumes are sport and have mould milk damages. Besides, a part of the document books to the calculations as well as a large number of the handbooks and diaries (approx. 140 pieces, i.e. approx. 5.5 es total stock) show beside mould and spores also water damages. Ten official books (invoice receipts and property tax section directories) are bound in such a way that parchment, which as a rule is inscribed with liturgical texts, forms the spine of the book in second use. Also thread-stitched files, as known from Prussian administration, can be found in Dept. 40. These are the official records (Protocollum Judicale, Dept. 40 No. 295 - 298). V. Tips for the use of the inventory The signatures of the individual sources are indicated with : City Archive Worms Dept. 40 No..... The often underestimated significance of the following sources should be pointed out here. In the volumes of documents relating to the invoices, in addition to newspapers (e.g. Dept. 40 No. 2409), there are also work chords (Dept. 40 No. 2469), invoices of various companies (Dept. 40 No. 2502), e.g. on work performed and material used for it (Dept. 40 No. 2504). The correspondence registers (e.g. Dept. 40 No. 651, No. 652) were also kept in full text in some years, so that the complete correspondence between the higher authority or private persons on the one hand and the mayor's office on the other hand can be traced in connection with the corresponding fact files. The significance of the inventory of estates as a source genre for genealogical, social and economic research should be pointed out in particular. The inventories are in the present stock under the classification group X.02.e. Inheritances and guardianship matters registered. There are also files on asset sharing and wills. For ease of use, the units of description have been sorted roughly alphabetically by surname, with all occurring surnames "underlined" at the same time. With regard to the index of persons, it should be noted that in very few exceptional cases the correct alphabetical order was broken. If the usual spelling of a common name was extremely changed, the allocation was made within the normal one, e.g. 'Pardong' instead of 'Bardong', here the classification took place under 'B'. If family names were used with equal weight in different spellings and their proximity was recognizable within the alphabet, no standardization or assignment was made, e.g. Ertelmeyer/Erdelmeyer. 1 On the biography of Prince Ernst II of Hohenlohe-Langenburg: Hereditary Prince Ernst Wilhelm Friedrich Karl Maximilian of Hohenlohe-Langenburg - hereinafter called "Ernst II" in distinction to his grandfather Ernst - was born on 13 September 1863 in Langenburg as the son of Princess Leopoldine, born Princess of Baden, and Prince Hermann of Hohenlohe-Langenburg. He spent his school time in Karlsruhe, his mother's home town, at the Grand Ducal Gymnasium, which he left after graduating from high school in 1881. He then studied law as part of a contemporary university tour which took him to Paris, Bonn, Tübingen and Leipzig between 1881 and 1884. In 1885 Ernst II took his first legal exam at the Higher Regional Court in Naumburg a. d. Saale and during his military officer training at the 2nd Garde-Dragonerregiment in Berlin-Lichterfelde in the years 1886-1889 he also used the available time for extensive social activities at the courts of Emperor Wilhelm I and his son Friedrich. After completing his training, Ernst II advanced in the military hierarchy to lieutenant-colonel á la suite of the army (1914). The hereditary prince then aspired to a career in the Foreign Office, for which he first used one of his frequent stays in London in 1889 as a kind of private 'apprenticeship' at the German embassy. Queen Victoria was a great-aunt of Ernst II, so that he could always move at the highest social level. In 1890-1891 he passed his diplomatic exam and then took up a position as 3rd secretary in the embassy in St. Petersburg. Already in 1892 Ernst II achieved his transfer to London with the help of his father, who had enough influence as governor of Alsace-Lorraine, where he served as 3rd embassy secretary until 1894. In this year the hereditary prince Prince Hermann followed to Strasbourg to work as legation secretary of the ministry for the Reichsland Alsace-Lorraine. In 1896 Ernst II married his cousin of the 3rd degree Alexandra (1878-1942), a princess from the British royal family, whose father Duke Alfred of Edinburgh had taken over the Thuringian Duchy of Saxony-Coburg and Gotha three years earlier. Together with his wife and the offspring who soon followed - Gottfried, Marie Melita, Alexandra, Irma and Alfred, who died shortly after his birth - Gottfried, Marie Melita, Alexandra and Irma moved his centre of life to Langenburg and finally left the diplomatic corps in 1897. He had begun to establish himself in his role as heir when, after the unexpected death of Alexandra's brother Alfred (1899), the open question of succession in Saxony-Coburg and Gotha required a settlement. Ernst II was assigned as regent and guardian for the new, still youthful Duke Carl Eduard, a task he took over in 1900 after the death of his father-in-law, so that he now stood for 5 years at the head of a German principality. After the end of the regency, during which he had acquired the goodwill of his Thuringian subjects through a liberal attitude, Emperor Wilhelm II, his 3rd cousin, gave him the prospect of a position as State Secretary and appointed him in 1905 provisional head of the Colonial Department in the A u s w ä r t i g e s A m t , which was to be upgraded to his own R e i c h s k o l o n i a l a m t . But because of internal quarrels and the resistance in the Reichstag against the financing of the new authority, the hereditary prince had to take his hat off again in 1906. The following year Ernst II returned to the political stage as a member of the Reichstag for the constituency of Gotha, in which he had run as a representative of the bourgeois parties against the SPD. As a guest student of the parliamentary group of the German Reich Party, he sometimes appeared with speeches in the plenum, but everyday parliamentary work remained largely alien to him. As a result of a special political constellation in the Reichstag, Ernst II nevertheless managed to be elected vice-president of parliament in 1909 as a compromise candidate for the right-wing conservative camp. But he was not able to carry out this task for long either, because he did not want to come to terms with the conventions of parliamentary debates. As early as 1910 he used the anti-Protestant "Borromeo encyclical" of Pope Pius X to resign from his office in protest, albeit at the price of no longer being able to play a political role at the national level in the future. In 1913 Prince Hermann zu Hohenlohe-Langenburg died and his son took over the noble inheritance, which also included the county of Gleichen in Thuringia. Ernst II successfully compensated for the loss of leading political offices through his increased commitment to social forces, which rather worked in the background: first and foremost the Protestant Church, the Order of St John and the Red Cross. Within these institutions he held important and influential positions at local and state level, through which - in conjunction with his memberships in numerous associations and federations - he was able to cultivate a broad network of correspondents from noble, political, scientific, ecclesiastical and cultural circles.As commentator of the Württembergisch-Badenschen Genossenschaft des Johanniterordens and honorary president of the Württembergischer Landesverbandes vom Roten Kreuz it was obvious for Ernst II not to strive for a position with the fighting troops, but in the organization of voluntary nursing at the outbreak of the First World War. After a short period as a delegate for each stage in Berlin and on the western front, he was appointed at the end of 1914 as the general delegate for voluntary nursing care for the eastern theater of war, so that he spent the longest period of the war in the eastern headquarters - among others in the vicinity of Field Marshal von Hindenburg. In 1918 he was finally promoted to the highest representative of his organization, the Imperial Commissioner and Military Inspector, and in this function he led, among other things, the German delegation to prisoner of war exchange negotiations with the USA in Bern. Here he benefited from his diplomatic experience, which the emperor had already drawn on in 1915, when he sent the prince to Constantinople and the Balkans as a special ambassador. After the end of the war, Ernst II resigned his high office in nursing and devoted himself again to his church and association activities. He paid special attention to the Protestant Commission for Württemberg, for which he acted as chairman of the Gerabronn district and the Langenburg local group as well as delegate in the regional committee. While the unification of the Protestant regional churches in the German Reich had already been of great concern to him as a Thuringian regent, in the 1920s and 30s he continued to campaign for the Protestant cause at church congresses and church assemblies in Württemberg and at Reich level. In 1926 the Langenburg prince was also appointed senior citizen of the Hohenlohe House, and in the same year he was elected governor of the Balley Brandenburg, i.e. the second man of the Order of St John in the Empire. During National Socialism, Ernst II, as in republican times, stayed away from political offices, especially as he was of an advanced age. From 1936 he invested a large part of his energy in the endeavour to have the Langenburg ancestral estate recognised as an inheritance court and also took care of the publication of his correspondence with the widow composer Cosima Wagner. 11 December 1950 Prince Ernst II died very old in Langenburg, where he was also buried. 2. inventory history, inventory structure and distortion: Before distortion, the estate was in a relatively heterogeneous state, which was due to an inconsistent way of transmission and multiple processing approaches. During the fire at Langenburg Castle in 1963 and the associated temporary relocation of documents within the building complex, the original order probably suffered its first damage, which was intensified in the subsequent period in the course of the transfer of Langenburg archives to Neuenstein. Probably the estate was torn apart and transferred to the central archive in several parts that could no longer be reconstructed in detail. At the latest during the administrative work carried out there in the 1960s under Karl Schumm, the written remains of Ernst II were mixed with other files from Langenburg. Further parts of the estate may also have arrived in Neuenstein in the following decade. Building on the gradually implemented provenance delimitation of the Langenburg archival records, a rough pre-drawing of the estate could be tackled in the early 1980s, but this was not completed. A last addition from the family archives was made to the now formed holdings in 1992 by the delivery of Ernst-related files, most of which had originated in the Langenburg authorities, in particular the domain chancellery.Ernst II regulated his correspondence with the help of registrar-like notes, which he usually affixed directly to the incoming documents. It contained information on the date, recipients and content of the replies and other written reactions. He also noted instructions to his administration and often complete drafts of letters on the incoming mail. In addition, the testator himself already arranged and sorted his documents further by forming units oriented to factual topics and correspondence partners and providing them with notes in the sense of a file title along with its running time. In general, he attached the notes to envelopes of different sizes, most of them used, which served as packaging or were enclosed with the files. Over the decades, Ernst seems to have repeatedly tackled such disciplinary measures, which had a long tradition in the family, without, however, being able to recognize a stringently maintained pattern. Only the rough distinction between factual and correspondence files formed a perceptible red thread, which was also observed in the current distortion. However, it must be taken into account that even in the fascicles formed according to subject criteria, parts of correspondence are often found, only compiled on a specific topic. Although this leads to overlaps with the correspondence series, the fact files were largely left as such and only slightly thinned out with regard to the correspondence partners, since they are mostly units that are comprehensible in terms of content and partly rich in content. While the 'file titles' created by Ernst II normally largely corresponded with the content of the fascicles, it must be noted for the following indexing approaches, also and especially for the preliminary indexing in the 1980s, that the names, dates and subjects noted on archive covers often deviated from the actual content and could hardly be used for the current indexing. The situation was aggravated by the fact that the mixing with files of foreign provenance - including the estates of Ernst's father Hermann and his wife Alexandra as well as the domain chancellery and court administration - could never be completely eliminated and therefore numerous individual files had to be sorted out in the course of the current processing. However, this separation of provenances was not implemented consistently in every respect, but in particular files from the Langenburg and Coburg-Gotha administration, which refer directly to Ernst II, were left in existence; the official records usually differ from the actual estate in the outward appearance in the form of differently coloured folders with file titles, running times and file numbers. Furthermore 2 fascicles on the death of Ernst II and at the end of his reign in Saxony-Coburg and Gotha come from the estates of Ernst's children Gottfried and Alexandra. A special case is Ernst's correspondence with Cosima Wagner, which is kept entirely in Neuenstein, so that not only the letters received from the deceased, but also the letters to the composer's wife (Ernst, his mother Leopoldine and his cousin Max von Baden), stored in bound folders, were recorded as part of the princely estate (see 4.).Thus, the newly registered estate represents an inventory enriched with personal material. In addition, it is to be expected that there will still be isolated files from the estates of relatives whose origin could no longer be clearly clarified (e.g. loose individual pages or fascicles which refer to festive events without naming an addressee or previous owner), apart from the principle of retaining the original separation of factual and correspondence files, massive interventions had to be made in the formation and titling of the fascicles. In many cases, due to later order work, mixing within the fascicles and unclear new file formations had occurred, otherwise about a quarter of the holdings proved to be largely unordered. Even the rather ad hoc sorting carried out by Ernst II himself did not follow any kind of 'file plan', so that content overlaps and repetitions were the order of the day. Therefore, in the course of the current distortion, fascicles were repeatedly reshaped or newly formed under consideration of either thematic or corresponding criteria. The extraction of individual documents for assignment to other fascicles was generally documented by enclosed notes. Individual photographs and photo series with illustrations of Ernst II. were separated and formed into a separate 'photo collection' (see 5.), and in order to provide a better orientation for the user, the find book of most of Ernst II.'s relatives shows the degree of kinship to the deceased in square brackets in the appropriate places.The collection La 142, Nachlass Fürst Ernst II., was arranged and recorded from June to December 2004 by archivist Thomas Kreutzer within the framework of a project sponsored by the Kulturstiftung Baden-Württemberg. History of the inventor: In 1884 the German Reich took over the protection of the Bremen merchant Franz Adolf Eduard Lüderitz by acquiring land; in 1885 the German administration was established; the German colonial society, founded in 1895, expanded the German sphere of influence; in 1915 the Schutztruppe surrendered to the armed forces of the South African Union and the German administration ended. Inventory description: Inventory history At the end of the 1930s, the Reichsarchiv took over the files of the Colonial Administration of D e u t s c h - S ü d w e s t a f r i k a, in some cases with considerable gaps in their transmission. After the relocation caused by the war, they were transferred to the Central State Archive in Potsdam in 1945. Here, the classification of the holdings into the central administration of Windhoek, the local administrations and the special administrations (justice, police, mining, railways) with their substructures, which had already been carried out in the Reich Archives, was preserved. The few volumes of files kept in the Federal Archives in Koblenz were assigned to the holdings after the reunification of Germany. Archive evaluation and processing In addition to the factual files of the most varied areas and administrative levels, the personnel files of the inspection of the state police as well as the railway administration and railway construction authorities form the most extensive groups of files with about 80 per cent of the transmission. The classification of the stock was carried out largely in accordance with the classification shown in the provisional finding aid, which was based on the registry scheme valid at the time. Only in a few individual cases were volumes assigned to a different classification. The order and titles of the volumes remained essentially unchanged. An index of persons, objects and places has been omitted, so that searches are only possible via the online version of this finding aid book.
