The Ministry of the Interior, created by the Decree of 10 October 1849, was the supreme head of the internal administration of the Land, insofar as it did not fall within the remit of other ministries or the State Ministry. The Ministry was in charge of the supervision of all local authorities and was entrusted with the management of the sovereign police force and the supervision of all police authorities and institutions. His tasks also included the handling of economic and general agricultural matters, including the regulation of property, farm and day labour relations, transport, association and press matters, the administration of roads and hydraulic engineering as well as social services. In addition, the Ministry's portfolio included citizenship matters, border and electoral matters, as well as civilian administration matters related to the military. Essentially, the business circle of the Ministry remained unchanged until 1945. It was extended in 1875 to include the civil status system. In 1905, the Ministry of Justice, Department of Education, transferred the affairs of the technical and commercial technical and further education school system from the Ministry of Justice to the Ministry of the Interior. During the First World War, the Ministry was responsible for controlling the food supply and the war economy, and after the war it was responsible for civilian demobilization. In 1919 the newly founded Ministry of Agriculture, Domains and Forests (see 5.12-4/2) took over the handling of agricultural matters, including rural labour and ownership, and in 1937 also agricultural water matters. There are gaps in the file tradition. Major losses were caused by the fire in the government building in 1865. At the beginning of 1945, files from 1933 to 1945 were deliberately destroyed in the Ministry. Most of the files of the Department of Social Policy from the period after 1918 were also lost. A. History of the Inventory Designer: Founded in 1933, since 1934 as a public corporation of the Reich subject to the supervision of Reichsju‧stizministers and Reich Minister of the Interior, responsible for the promotion and Ver‧wirklichung of the "National Socialist Program in the Entire Field of Law" Long Text: Founding and Legal Foundations The Academy for German Law was constituted on 26 March 1933. The constituent meeting was attended by the Reich Secretary of the Federation of National Socialist German Lawyers Dr. Heuber, Professors Dr. Wilhelm Kisch and Dr. von Zwiedineck-Südenhorst, the General Director of the Munich Reinsurance Company Kißkalt, two representatives of the business community and the future Director Dr. Karl Lasch. On 22 September 1933 a Bavarian law was passed (Bayerisches Gesetz- und Verordnungsblatt No. 37, p. 277), the only article of which granted the Academy the status of a public corporation. The articles of association were attached as an annex, according to which the provisional seat was to be Munich and which outlined the tasks of the new corporation as follows: By "applying proven scientific methods" it should "promote the reform of German legal life (...) and implement the National Socialist programme in the entire field of law and economics (...) in close and permanent liaison with the bodies responsible for legislation". In detail, her sphere of activity included cooperation in drafting laws, in the reform of legal and political science education, in scientific publications and the financial support of practical scientific work for the research of special fields of law and economics, the organisation of scientific conferences and teaching courses as well as the cultivation of relations with similar institutions abroad. The office of the Führer of the Academy was to be held in personal union by the head of the Reichsrechtsamt of the NSDAP; he was responsible for the external representation of the ADR, its internal management, all personnel decisions and the decision on amendments to the statutes as well as the dissolution in agreement with the Führer of the NSDAP. As auxiliary organs a deputy, a leader staff and a treasurer as well as the department heads of the specialized departments to be created were intended. The Bavarian State Ministry of Justice should be responsible for supervision. The members of the Academy, whose number should not exceed two hundred, were to be appointed for four years; ordinary, extraordinary, sponsoring and corresponding members were distinguished. At the first German Lawyers' Day in Leipzig, the establishment of the Academy for German Law was solemnly proclaimed on 2 October 1933. This already showed that Frank was striving to turn the Academy into an institution of the Reich, which would give him the opportunity to influence the Gleichschaltung der Justitz in the Länder even after he had completed his work as Reich Commissioner for the Unification of the Justitz. On 18 June 1934, the draft of a law on the Academy for German Law was sent to the head of the Reich Chancellery for submission to the cabinet (BA, R 43 II/1509). The Reich Minister of Justice agreed after it had been clarified that the Academy should receive its own funds and not burden the Reich, the Länder or the communities. At the request of the Reich Ministry of the Interior, the draft was amended to provide for joint supervision of the Academy by the Reich Ministry of Justice and the Reich Ministry of the Interior. After adoption in the cabinet meeting of 3 July 1934, the law was passed on 11 July 1934 (RGBl. I. S. 605), with which the Academy for German Law became the public corporation of the Reich; a new statute was attached. With this law, the Academy's tasks changed only to the extent that the responsibility for the reorganization of German legal life in the field of business ceased to exist. The headquarters remained in Munich. The Führer of the Academy became an honorary president, whose appointment was made by the Reich Chancellor. The binding of the office to the management of the Reichsrechtsamt of the NSDAP ceased. As an organ of the Academy, in addition to the President, a Presidium also provided support and advice. The maximum number of members was set at 300. Committees were set up to carry out the practical work of the Academy. The law of 11 July 1934 was not amended until 1945. In November 1934 a change was planned, which provided for a salary for the president according to the regulations for Reich officials. However, the draft was removed from the agenda of the cabinet meeting of 4 December 1934 (BA, R 22/198, R 43 II/1509) on Hitler's instructions. On the other hand, two amendments were made to the statutes, first on 16 October 1935 (RGBl. I. p. 1250). It provided that, in the event of the dissolution of the Academy, its assets would fall to the Reich, due to the taking up of a high mortgage, which the Academy had taken up to expand its Berlin house. More serious in its significance was the second amendment of 9 June 1943 (Reichs- und Staatsanzeiger of 9 June 1943). It was initiated by the new President, Reich Minister of Justice Dr. Otto Thierack. He prohibited the acceptance of private donations for the Academy and abolished the office of treasurer. The new constitution submitted to the Reich Ministry of Justice by the director of the Academy Gaeb on 10 December 1942 was to take this into account and at the same time streamline the provisions (BA, R 22/199). After consultations in the participating Reich ministries, the new constitution was finally formulated in a meeting on 8 June 1943 between representatives of the Reich Ministry of Justice, the Reich Ministry of the Interior and the Academy, signed on 9 July 1943 and published on the same day. In addition to the abolition of the office of treasurer and the institution of supporting members, the main changes were the inclusion of provisions on the President's auxiliary organs and the scientific structure of the Academy, which had previously been included in the structure regulations and the administrative regulations, as well as in a clear arrangement. The aforementioned Aufbauordnung had been issued on 15 December 1936 as an order of the President concerning the reorganization of the scientific work of the Akademie für Deutsches Recht (Zeitschrift der Akademie für Deutsches Recht 1937, p. 23). It defined the structure of the scientific apparatus of the Academy. The first of these, the Honorary Senate, was of little importance, while the other two, the Department of Legal Policy for Legal Policy and the Department of Legal Research for Scientific Research, were of decisive importance. It also dealt with the future centre of the Academy, the "House of German Law", for which the foundation stone had been laid a few months earlier and which was to house the research and educational facilities of the Academy. On April 1, 1937, the President had supplemented and extended the Academy's administrative regulations (Zeitschrift der ADR, p. 405f.) by enacting them, which outlined in more detail the tasks of the individual organs, namely the treasurer and the director, who were responsible for the financial and general administration of the Academy, the director of scientific and legal policy work, the committee chairmen, and the class secretaries entrusted with the direction of the classes. Eight administrative units were also listed, one each for the Legal and Legal Research, Personnel and Legal Office, Organisation, Libraries, Periodicals and Press, International Transport and Cash and Accounting departments. After the amendment of the statutes of 9 June 1943, on 10 June 1943 there was also an amendment to the administrative regulations (Zeitschrift der ADR 1943, p. 37f.), in which the provisions on the treasurer's office were completely omitted and the explanations on the administration were greatly shortened. The extensive information on the administrative departments has been replaced by brief information on the division of units, which has existed for a long time. Organisation and staffing The President of the Academy possessed extensive powers - apart from his ties to the supervisory ministries. His appointment by Hitler and the honorary position, which presupposed a further office securing its holder financially, could give him weight vis-à-vis the authorities and party offices. Its founder, Dr. Hans Frank, was appointed the first President on August 1, 1934. In his memoirs "In the Face of the Gallows" he confesses that the Academy was to be an important means of shaping law for him, especially since the Reichsrechtsamt, of which he had been head since 1929 and which secured him a place in the highest party hierarchy, lost more and more of its importance in the period after the assumption of power, and the NS-Rechtswahrerbund, of which he had held the leadership since 1928, offered only little scope for influencing legislation. Frank's ideas were acknowledged when, after his assignment as Reich Commissioner for the Gleichschaltung der Justiz in den Ländern had ended, he was dismissed by Hitler on 19 March. In the letter of appointment, the Akademie für Deutsches Recht was described as an institution which enabled him "to participate in the implementation of the National Socialist ideology in all areas of law without restriction to the judiciary in the narrower sense", i.e. an expansion of the scope of duties beyond the framework of law-making into the other areas of legal life, which in this form emanating from Hitler represented an important expansion of power. Frank could thus see himself in possession of a kind of special ministry for National Socialist legal formation in competition with Gürtner's Reich Ministry of Justice. In the years up to 1939, Frank, whose ministerial office moved from his first residence at Voßstraße 5 in Berlin to the Berlin building of the Academy at Leipziger Platz 15 on July 3, 1935, remained closely involved with the work of the Academy and legal policy. His attempt in 1939 to free himself from the annoying supervision of the Reich Ministry of Justice and the Reich Ministry of the Interior, which made him dependent on Gürtner and Frick above all with regard to possible changes to the statutes, but also in financial matters, and to subordinate the Academy to his supervision as minister remained unsuccessful (BA, R 2/24103). Frank's presidency ended in August 1942, after his appointment as Governor General in Poland on 12 October 1939, when business had been conducted practically by the Deputy President. Hitler released Frank from his office as President of the Academy with a deed of August 20. It was not true, however, when Frank told his deputy Professor Emge that the reason for the dismissal was the "overcrowded and ever increasing burden" of his duties in the Generalgouvernement. On the contrary, Frank had aroused Hitler's displeasure because between 9 June and 21 July 1942 he had defended law, judicial independence, personal freedom and humanity against the police state in four speeches at the universities of Berlin, Munich and Heidelberg as well as at the Academy of Sciences in Vienna (cf. H. Weinkauff, Die deutsche Justitz und der Nationalsozialismus, 1968, p. 74, 161f.) This solo effort, which was directed primarily against Himmler and Bormann, also led to a ban on speaking and the loss of his position as Reichsrechtsführer and head of the Reichsrechtsamt, which was dissolved. This also involved a change in the office of deputy president, which had to be appointed by the president according to the statutes of 1934 and confirmed by both supervisory ministries. Frank had been represented since 1937 by Dr. Carl Emge, Professor of Philosophy of Law at the University of Berlin, after the Vice-President Privy Councillor Prof. Dr. Wilhelm Kisch, Professor of Civil Procedure and German Civil Law at the University of Munich, who had been appointed in 1933, had resigned for health reasons from his office. Emges was replaced in November 1942 by the State Secretary in the Reich Ministry of Justice, Dr. Rothenberger. Whether after Rothenberger's dismissal (January 1944) his successor, Herbert Klemm, was also appointed deputy president of the academy after Rothenberger's dismissal as state secretary cannot be determined. The second organ of the Academy, besides the President, was the Presidium. Emerging from the Führerrat of the Academy provided for in the 1933 Law, it had the task of supporting and advising the President, determining the budget and carrying out the preliminary audit of the budget account. According to the administrative regulations issued in 1937, the president, his deputy, the treasurer and the head of the scientific and legal-political work belonged to him by virtue of office. For this purpose, the President could appoint further members of the Academy to the Presidium, which should meet at least once a year. In accordance with the new administrative regulations of 10 June 1943, the Reich Ministers of Justice and Home Affairs joined as new permanent members. The Reich Minister and head of the Reich Chancellery Lammers also belonged to the Presidium. The actual work of the Academy in the fields of legal policy and legal research was directed by the Head of Scientific and Legal Policy Work, who was appointed by the President from among the members and who gave guidelines and assigned tasks to the Legal Structuring and Research Departments. This office, which was particularly important for the work of the Academy after the strong use of Frank by his tasks in the Generalgouvernement, was initially held by State Secretary Freisler, later by the Deputy President. As long as the Academy was supported entirely or to a considerable extent by the voluntary donations of its supporting members, the Treasurer was of great importance. He was responsible for all financial and property management, in particular the supervision of the budget and all contracts affecting the Academy's finances. From the beginning, the function was held by a close confidant of Frank, General Director Arendt, who kept it until its abolition in 1942. However, the treasurer had already lost influence in 1939, since the Reich made an ever larger subsidy to the academy budget and its control thus became stronger and stronger. The general questions of organization, administration, and human resources of the Academy for German Law, as well as the liaison with the Reich authorities, lay with the Director of the Academy. Dr. Karl Lasch held this post from 1933 until his appointment as governor of the Radom district in 1939, after which Dr. Gaeb took over the post as deputy director of the Diplomvolkswirt, which he held until 1945. The members of the Academy were divided into different groups according to their rights and tasks. The core consisted of 300 full members, initially appointed for four years; the number was maintained in 1943, and membership was extended to 10 years. According to Frank, the limitation to a relatively small number should emphasize the elitist character of the academy and awaken an elite consciousness among its members. In addition to legal, political and economic scientists, lawyers and senior civil servants, there were also some corporate members, including the law and political science faculties of the universities, which were represented by their deans. Extraordinary members by virtue of office were the Reich Ministers of Justice and Home Affairs. Foreigners who were interested in the Academy's work and were willing and qualified to contribute to it were accepted as corresponding members. The sponsoring members should maintain the Academy financially. These were mostly commercial enterprises, some of which were actively established and were prepared to make a contribution that varied according to their financial means for the honour of formally belonging to the Academy. The disadvantage of this financing system was that it created a financial dependence on the donations and could arouse suspicion that the donors were influencing the work of the Academy. It was eliminated by prohibiting any acceptance of donations in 1942. The work of the Academy was carried out in the Departments of Legal Design and Legal Research. All ordinary members of the Academy were organised, supervised and directed by the head of scientific and legal policy work. The Legal Department, to which all full members belonged, had to bear the main burden. In numerous (up to over 70) committees which changed over the years, often divided into main, sub and special committees as well as working groups or central committees, it discussed current questions of legal policy and participated in the legislative preparations of the ministries through proposals, statements, expert opinions and drafts. At the Academy's tenth anniversary in June 1943, Thierack was able to point to a considerable number of laws in which it had played a significant role until 1941, including the German Community Code and the 1935 Wehrgesetz (Wehrgesetz - Wehrgesetz - Wehrgesetz - Wehrgesetz - Wehrgesetz - Wehrgesetz - Wehrgesetz - Wehrgesetz - Wehrgesetz - Wehrgesetz - Wehrgesetz - Wehrgesetz - Wehrgesetz - Wehrgesetz - Wehrgesetz - Wehrgesetz - Wehrgesetz - 1935, the 1937 German Civil Service and Stock Corporation Laws, the 1938 Youth Protection and Marriage Laws, the 1939 Law on the Introduction of Compulsory Insurance, and the 1939 Law on the Introduction of Legal Structure, which dealt particularly intensively with the reform of criminal law and the creation of a new People's Code. After the beginning of the war, numerous committees were suspended and, as the war lasted longer, dissolved. Nevertheless, the work did not come to a standstill. Only the emphasis shifted to all matters related to the war, e.g. air-raid protection law and, above all, nationality and international law. The relevant committees dealt in detail with issues relating to the reorganisation of the European continent, but also with maritime and land warfare and relations with the USA. At Frank's request, the Academy also took a stand on questions of German politics in the East and a reorganisation of the Generalgouvernement; it issued a secret report in January 1940: "Rechtsgestaltung deutscher Polenpolitik nach volkspolitischen Gesichtspunkten" (BA, R 61/243, Document 661-PS of the Nuremberg Trial against the Chief War Criminals). In 1942 the Academy still had 76 committees with eleven subcommittees. After all committees that had dealt with peace issues had been gradually suspended or completed their work, by the end of 1943 only committees with directly war-related tasks remained, including the committees on social security and international law. The committees involved in the drafting of the planned National Code also suspended their work, with the exception of the main committee, which only continued the necessary work. The scientific work was carried out within the Academy of German Law by the Department of Legal Research. Only scientists have been appointed to this department. Her task was to research the history, methodology and knowledge of the law and later also of the economy; she met in working groups, which were grouped into classes. First there were three classes, of which class I dealt with the study of the history and basic questions of law, class II with the study of the law of "people and empire" and class III with the study of the "people's federal" legal life. Each class was headed by a class leader. The management was carried out by a class secretary. The offices were initially filled as follows: Class I: Chairman: Prof. Dr. Heymann, Secretary: Prof. Dr. Felgentraeger Class II: Chairman: Prof. Dr. von Freytag-Loringhoven, Secretary: Prof. Dr. Weber Class III: Chairman: Prof. Dr. Weber Dr. Hedemann, Secretary: Prof. Dr. Lange After the war began, there were only class secretaries left, namely for Class I Prof. Dr. Heymann, for Class II Prof. Dr. Gleispach, for Class III Prof. Dr. Hueck. The Department for Legal Research published the series of publications, the working reports and the yearbook of the Academy for German Law and from 1941 also "Das deutsche Rechtsschrifttum". She was also in charge of the quarterly "Deutsche Rechtswissenschaft" and the collection of non-German penal codes. Within the framework of the department there was a committee for the examination of the law study regulations, which in 1939 presented its results to the Reich Ministry for Science, Education and People's Education. In 1940 a fourth class came into being with increasing importance of economic questions, which was responsible for the research of the "national economy" and which was to make the results of economic science accessible to the authorities and offices for the execution of practical tasks. In August 1944, on the instructions of the President, the work of the remaining committees and working groups was discontinued "for the further duration of the war" as well as the promotion of the individual members of special research commissions (letter from Thierack to Lammers of 12 August 1944, BA, R 43 II/1510a). The Academy maintained close contact with foreign countries through its corresponding members. Visits by foreign scientists, students, but also politicians were frequent. In addition, the German sections of various foreign institutions were affiliated to it. On the other hand, efforts were made to expand the Academy's sphere of influence by establishing new companies or maintaining close contact with existing companies in Germany. For the work abroad, there was a separate department in the administration of the Academy, which looked after the associations; as far as purely German organisations were concerned, the support was provided by the specialist departments of the Legal Structuring Department. In the period of its existence the following associations were affiliated to the Academy of German Law: 1. German Section of the International Institute of Administrative Sciences 2. German National Group of the International Law Association 3. German Association for the Protection of Intellectual Property and Copyright 4. International Association for Financial and Tax Law 5. German Society for Financial and Tax Law 6. German Society for Prisoners (affiliated since 1935) 7. Society for Legal and Political Sciences in Vienna 8th Society for German Criminal Law 9th Working Groups: a) for the German-Bulgarian legal relations b) for the German-Italian legal relations c) for the German-Polish legal relations (until 1939) d) for the German-Hungarian legal relations Library and Publications The establishment of a reference library for academics working in the Academy began early on. It was Frank's aim to develop this library into a central collection point for all important legal literature and related areas. The basis was the purchase of the library of the legal historian Prof. Karl von Amira, who died in 1930; later the library of the Munich jurist Prof. Konrad Beyerle was also acquired. Further accesses from various sources, mostly through taxes from authorities (e.g. the library of the former R e i c h s k o l o n i a l a m t , the duplicate holdings of the R e i c h s c h s a r k a m e in Potsdam as well as duplicates of foreign law collections and periodicals from the R e i c h s t a g s a l bibliothek) brought the holdings to around 60,000 publications by 1937. Although the library was primarily intended to serve the Academy, it was basically open to any qualified interested party. An "archive" was attached to the library, which, on Frank's instructions, created 1. a "card index of Jewish legal authors", which "eradicated Jewish literature from the library or from the library". The aim was to remove the works of Jewish authors from all public libraries or libraries serving study purposes and to transfer them to their own departments "which were to indicate the activities of the Jews and the Jewish people"; 2. to edit a card index of general legal writers by author and by work. In addition, a collection of portraits of lawyers, a collection of press clippings on the topics "Law in the Press" and "Academy in the Press" as well as a collection of journal articles from the entire body of jurisprudential literature were in the works. The first library director, Utschlag, also designed a large exhibition on legal history and law in general, which the Academy organized in conjunction with the Faculty of Law of the University of Munich on the occasion of the 1936 Annual Conference in Munich under the title "Das Recht" (The Law). The journal of the Akademie für Deutsches Recht, founded in 1934, provided information on the ongoing work of the Academy and on current legal issues. It was initially supervised by the Academy's own office for writing and finally transferred to the C-H. Becksche Verlagsbuchhandlung in 1937, where it was published until 1944. In addition to detailed reports on the representative events of the Academy (often also as special supplements or commemorative editions), it produced essays, news on organisational changes and the activities of the Academy's working committees, as well as book reviews. In addition, the journal published court decisions of a fundamental nature from 1935 onwards. The decisions were forwarded to the Academy by the courts via the Reich Ministry of Justice. The President acted as editor, the main editor was initially Director Dr. Lasch, then Kammergerichtsrat Dr. Lauterbacher. From 1 January 1939, Deutsche Rechtswissenschaft was published quarterly as the second journal. With the consent of the Reich Minister for Science, Education and Popular Learning, it was transferred from the previous editor Prof. Dr. Karl August Eckhardt to the Department of Legal Research. They brought treatises, contributions and book reviews. The Academy also published the Zeitschrift für Wehrrecht and was involved in the publication of the Zeitschrift der Vereinigung für gewerblichen Rechtsschutz, the Zeitschrift für vergleichende Rechtswissenschaft, the Blätter für Gefängniskunde and the Gerichtssaal. The yearbook of the Academy for German Law should give an overview of the work within one year. It was also published by the President and in its first editions offered a good overview of the most important events in the Academy and its committee work, while later larger treatises on individual issues predominated. In the first years, detailed information on the committee's activities could be obtained from the work reports, which were produced in small print runs using the transfer printing process and were intended only for the confidential information of party offices and authorities and were not to be circulated further. In addition, there was another - public - series of working reports of the Academy for German Law, in which the chairmen published the results of their committees. For more extensive scholarly work that had emerged from the Academy, the series was to serve the Akademie für Deutsches Recht, of which about 80 volumes were published; it was divided into individual groups according to subject areas. Finally, the Academy continued the collection of non-German penal codes organized by the editor of the Zeitschrift für die gesamte Strafrechtswissenschaft and published individual writings on special occasions, e.g. on the occasion of the opening of the House of German Law. Financing and assets In his memoirs of 1946, Frank emphasized the financing of the Academy for German Law, which was independent of the "Reich, State, and Party," with which he had hoped to preserve the actual non-partisanship of his institute. In fact, in the first years of its existence, the Academy was almost entirely maintained by donations from third parties, the supporting members, which included both private individuals and business enterprises. The Reichsjustizministerium had also made its approval of the transfer to the Reich dependent on the academy having to carry itself. In the accounting year 1935/36, donations reached the record level of over 1 million RM, and in 1936, 70 donors raised just over 500,000 RM. This was sufficient to cover the expenses, especially since the Reich Ministry for Science, Education and Popular Education had made available a one-time sum of 250,000 RM for the promotion of scientific work. On the other hand, already in 1937, despite a donation volume of almost 700,000 RM by 94 donors, there was a shortfall which had to be covered by donations for the accounting year 1938. In March 1938, General Director Arendts, the Treasurer of the Academy, declared in a meeting with the responsible adviser of the Reich Ministry of Finance, in which also Director Lasch took part, "that the Academy would strive for its entire budget of about 750 - 800,000 RM to be gradually fully supported by contributions from the Reich over the course of about three years," and justified this with the "aim of developing it into a legislative institution of the Reich. In its audit report for the years 1936-1937 of 24 March 1939, the Court of Audit of the German Reich also took the view that a continuation of the previous method of financing was not compatible with the reputation of the Reich; it was the duty of the Reich to "place the financing of the tasks on a sound basis" (BA, R 2/24103). This became indispensable after the Reich Minister of the Interior, in agreement with the deputy Führer, finally rejected a collection permit for the Academy in July 1939 on the basis of the Collection Act of 5 November 1934. This also meant that advertising had to be discontinued for which the company had used its own advertising specialist. In the accounting year 1939/40, the donations fell to 290,000 RM, and for the first time a subsidy from the Reich of about 480,000 RM was granted towards the running costs, so that these were now predominantly borne by the Reich. Although in 1940/41 the income from donations increased again somewhat, the donations already received for 1942 were transferred to the Dankspendenstiftung des Deutschen Volkes on Thierack's instructions. The Academy for German Law was now financed entirely from the Reich's budget. The Akademie für Deutsches Recht used considerable financial resources to provide representative accommodation. On 6 June 1935, the Lachmann-Mosse trust administration acquired the house and property at Leipziger Platz 15 from a foreclosure sale for the Berlin office at a price of RM 1.25 million. Of the purchase amount, one million RM was raised by eight mortgages of a group of insurance institutions, for which the Reich took over the interest and redemption service at the expense of the budget of the Reich Ministry of Justice; this was the reason for the amendment of the statutes that, in the event of the dissolution of the Academy, its assets would fall to the Reich. The annual contribution to be paid by the Reich was 50,000 RM for a period of 25 years. The remaining purchase price of 250,000 RM was to be paid interest-free in five annual instalments of 50,000 RM, which were to be raised from donations. Much more elaborate was the construction of a "House of German Law" at the Academy's headquarters in Munich. The first plans from January to June 1936 provided for three components, for which over 5.3 million RM were estimated. In the course of the negotiations, the mammoth project shrank to two construction phases. On October 24, 1936, on the occasion of the second annual conference of the Academy, Reichsminister Rust laid the foundation stone for Building I, front building and reading hall. The costs were to amount to RM 2,2 million, raised by a loan from the Reich Insurance Institution for Employees, the interest and repayment service of which was taken over by the Reich. Already on 31 October 1937 the academy could celebrate the topping-out ceremony, on 13 May 1939 the opening of the building unit I. The former Max-Joseph-Stift, which was to be renovated and extended by a festival hall, was acquired as Building II for a price of more than RM 1.3 million; in June 1938, the Reichsversicherungsanstalt took out a further loan of RM 2.2 million, the remainder of which was frozen at RM 900,000, however, when construction work was stopped after the outbreak of the war. Administration and registry The administrative apparatus of the Academy gradually developed from July 1934. Initially, most of the service operations were carried out in the Berlin office building; in addition, there was a small office mainly for the construction of the planned extensive library at the headquarters in Munich. It was only after the completion of Building I of the House of German Law in 1939 that the construction of a larger, structured office began, the management of which was placed in the hands of a speaker of its own. According to the rules of procedure, which the Academy submitted to the Reich Ministry of Justice in September 1935 (BA, R 22/198), the administration was divided into departments, headed by a speaker, assisted by an assistant. The speakers were assessors or younger officials on leave in the starting positions of their careers, provided they had knowledge of economics. The president used a presidential chancellery as his personal office. The management of the entire service operation was the responsibility of the Director of the Academy, who had a personal consultant at his disposal. The Director was also in charge of the Organisation Division, which was responsible for the preparation and implementation of the events. The office service was headed by a personnel officer who, in addition to personnel processing, was also in charge of registry and law offices, house and property administration as well as budget monitoring tasks. Other speakers assisted the committee chairmen of the Legal Department, generally one for four committees. In contrast, only assistants were assigned to the secretaries of the three research classes. For the entire financial and asset management, the preparation of the budget, the cash and bookkeeping, accounting, for the conclusion of contracts and the remaining budget management, the treasurer provided the necessary forces free of charge with the exception of an advertising expert and an assistant. The foreign department, which in addition to maintaining foreign contacts also supervised foreign publications, the exchange of journals and literature and the management of the affiliated international societies and associations, was relatively well staffed with a speaker and his deputy, a scientific assistant, an interpreter and a (part-time) unskilled worker for Slavic languages. The administrative regulations of the Academy of 1937 combined the previous organizational forms into nine administrative offices, which in January 1938 comprised one to seven departments, depending on the area of responsibility. These units corresponded to the previous departments. The most extensive was the Administrative Office for Legal Structuring with seven units (I - VII). The administrative office for magazines and press had two (X, XI), the others (legal research, libraries and international transport) had only one each (VIII, IX, XII), as did the administrative offices for cash and accounting (XIV), organisation (XV) and human resources and law firms (XIII), which, however, were also grouped under a central unit. In addition, there was a unit XVI (Legal Office) as the "Legal Office of the ADR". This organization continued to exist in principle even during the war, but with the resulting drastic personnel restrictions, which in the beginning practically paralyzed the entire academy apparatus, but later allowed it to remain in operation. After the closure of the Academy's work, whose offices were moved to the Reich Ministry of Justice building at Wilhelmstraße 65 on 10 January 1944, most of the staff was released at the end of 1944, but parts (finance) continued to work until March 1945. The files produced during the Academy's activities were initially kept in so-called departmental registries, i.e. the written records of the individual speakers. It was not until 1938 that the at least partial compilation of the written material produced so far began in a central registry. The consultant responsible for the law firm was in charge of the execution. At first, the registry business of the Legal Department was taken over, later that of the main administrative office (without the personnel files). The Department of Legal Research initially refrained from handing over its records to the Central Registry. The registry of the foreign department remained independent. Nothing significant could be ascertained about later changes in the registry system. During the establishment of the House of German Law in Munich, a registry was also set up there. It is certain that since the merger of the registries in 1938 the corresponding files have been filed according to a uniform and systematically structured file plan. As of 1940, this plan (BA, R 61/34) comprised seven main areas divided into three groups and sub-groups. The file plan was structured according to the decimal system with four-digit digits, to which an additional digit and a year could be added by slash if necessary. In addition to the documents produced in the course of administrative activities, an extensive complex of documents, characteristic of the Academy and its work, has emerged in the form of minutes of meetings of the committees and other specialist bodies, some of which are based on extensive stenographic notes. Copies were kept in the registry and in the "archive" of the magazines and press department. They form the most important part of the stock. The division began as early as 1943, when the two offices moved files, books and inventory to smaller towns in the area to protect them from air raids, the Munich office to Altötting, Griesbach and Wegscheid (district court), the Berlin offices primarily to the Feldberg (Mecklenburg), Havelberg, Prenzlau, Zehdenick and probably also Templin storage sites also used by the Reich Ministry of Justice, and the Cochem Castle. Some of the files removed from Berlin were confiscated by Russian troops. Since 1957 they have been in the Central State Archives in Potsdam, where they formed the holdings 30.13 (Overview of the holdings of the German Central Archives 1957, p. 86). This had a volume of 155 volumes from the period 1933-1942, 33 of which refer to the activities of the committees and 31 of which apparently originate from the foreign department of the Academy; the holdings include files of the Association for the Improvement of Prisoners (25 volumes) and the German Society for Prison Science. In the hands of American troops fell, in addition to Munich files, the documents still available in the Berlin office at the end of the war, as well as files that had apparently still been brought from Zehdenick to Thuringia in 1945. Most of this stock was transferred via the Ministerial Collecting Center near Kassel to the World War II Records Division of the American National Archives in Alexandria, Va., where it formed the Record Group 1036 with other German documents. A smaller part was handed over to the Federal Ministry of Justice at the beginning of the 1950s, and the file of lawyers and economists remained with a branch of the US Army in Germany. In Alexandria the files were filmed in 1958 by the American Historical Association and described in 1959 in volume 6 of the Guides to German Records Microfilmed at Alexandria, Va., pp. 14-27. In 1960 this part of the collection was transferred to the Federal Archives, which in 1962 was also able to take over the remaining files from the Federal Ministry of Justice and the aforementioned index. In a final return, the Federal Archives received documents from the Academy in 1973 from the Library of Congress, Washington D.C. Some files of the Committee for German-Italian Legal Relations had been transferred to the Institut voor Oorlogsdocumentatie in Amsterdam after the end of the war; they were also made available to the Federal Archives by the latter in 1974 for further completion of the R 61 collection, which had meanwhile been formed from the existing files. Finally, the Institute for Contemporary History, Munich, which had been able to acquire some of the copies of the minutes of the committee meetings collected in Munich and the reference files of the ordinary professor Dr. jur. Hermann Krause (1939-1944 member of the main committee of the academy), also left its documents to the Federal Archives; and in March 1976, it was able to acquire the reference files of Reg. Dir. a.D. and then member of the board of Deutsche Centralbodenkredit AG, Oesterlink, member of the Mortgage Legal Committee of the Academy, will close a lore gap in this area. Thus all surviving traditions of the Academy for German Law outside the GDR were probably brought together in inventory R 61. In 1990, the part of the archive that had been preserved in the Central State Archives of the GDR was merged with R 61. Archivische Bewertung und Bearbeitung (only old stock R 61, without ZStA 30.13) The written material of the Akademie für Deutsches Recht consists essentially of two parts which are already clearly separated from each other. In addition to an extensive collection of factual and correspondence files, the "Archive" of the Press and Periodicals Office contains a considerable part of the collection of minutes and minutes of meetings, some of which can also be found in the files of the Legal Department. From 1938, with a few exceptions, the Academy's documents were filed in a central registry according to a systematic file plan. The filing was done chronologically from bottom to top, but was often disturbed afterwards. In order to eliminate the - often severe - irregularities and to improve the usability of the holdings, all subject units and individual processes were placed in an official filing system (from top to bottom) when the holdings in the Federal Archives were organized and listed in 1967, and torn file units were reunited in the process. Loose written material was reformed after factual matters. The files are therefore no longer in the same condition as they were when they were filmed in the USA, so that an identity between the volumes with the American signatures ADR 1 to ADR 238, some of which also referred to documents of other provenances, and the volumes signed in the Federal Archives exists only rarely; as far as possible, however, the corresponding American signatures were noted, and in addition the concordance between the signatures of the Federal Archives and the role designations of the microfilm T-82 (below pp. 87-90) makes a comparison possible. Cassations were primarily carried out in subject groups, most of which have been preserved in their entirety in the Federal Archives. In addition to the removal of numerous duplicates, administrative documents in particular were freed from all insignificant correspondence. Most of the submissions to committees on private legal matters of no general importance were also largely destroyed. Since the records and minutes were originally also available in the registry of the Academy, the reorganization of the status quo, which is not, moreover, based on the old file plan scheme, attempted to restore the old unit of records and minutes of the individual committees and other working bodies of the Academy of German Law as far as possible, whereby the internal "provenance" (registry or "archive") in the file directory is expressed only by the old signature. The records filed in the registry shall bear the letter "P" in front of the file number, unless they are in correspondence, and the "archive" copies shall not bear a signature. In order to indicate the separation of the holdings into the partial provenances of Berlin and Munich, the place of origin has also been entered in the Remarks column, as far as determined. History of the Inventory Former: The Bank der Deutschen Luftfahrt, also known as the Aero- or Luftfahrtbank, was formed by the transformation of Luftfahrtkontor GmbH into a public limited company with shareholder resolution of 6 July 1940, the object of which, according to the articles of association of that date, was "the execution of banking transactions of all kinds and of related transactions serving directly or indirectly aviation purposes, as well as the administration and supervision of aviation companies and the execution of all such transactions, including in a fiduciary capacity" [1]. Luftfahrtkontor GmbH had been founded in 1933/34 in the context of the takeover of the Junkers group by the Reich Aviation Ministry (RLM) and in 1938 was responsible for the administration of 1. the Reich-owned facilities leased to companies in the aviation industry, 2. the Reich's holdings in companies in the aviation industry and 3. the investment loans [2]. In the course of the so-called "capital cut" to reform corporate financing, the investment loans granted until then were converted into state aid for special depreciation and firms were encouraged to use more of their own funds and borrowed capital to finance investments. To this end, both the RLM and the Reich Ministry of Finance (RFM) considered it sensible to set up their own commercial bank for aviation, whose loans were intended to stimulate the involvement of other banks and other donors and to which all Reich shareholdings in the aviation industry and aviation were to be transferred. On 9 June 1939 Luftfahrtkontor GmbH received its banking licence from the Reich Commissioner for Banking and quickly acquired the character of a "universal bank for German aviation" [3] after the start of the war. In addition to the conventional investment loans, the Luftfahrtbank increasingly granted the aerospace armaments companies - similar to the Deutsche Industriebank for the suppliers of the army and navy - the credit assistance provided by the Reich Economic Ministry (RWM) for the mobilization of arms production (in short: "mobkredite") with Reich guarantees from autumn 1939 onwards. This resulted in a substantial increase in the Bank's lending volume, which, together with the significant increase in managed participations and deposits from aviation companies, as well as increased activity on the stock exchange and the money market, led to the Bank being renamed "Bank der Deutschen Luftfahrt" and converted into a stock corporation (AG). This was in response to the wish of the General Airworthiness Officer Ernst Udet that "the company's status as a bank should be expressed in the company name" [4]. Like its predecessor Luftfahrtkontor, the Bank der Deutschen Luftfahrt initially resided in Berlin-Schöneberg, Am Park 12. In the night from March 1 to March 2, 1943, Ge‧bäude burned out completely after an Allied air raid, whereupon the bank had to move its Geschäfts‧räume to the center of Berlin (Werderstr. 7). As a result of the fire, loss of files also seems to have been the cause of complaint [5]. Dissatisfied with the accommodation that was not considered to be standes‧gemäß, the bank pushed in the spring of 1944 the efforts that had previously been made by the Jewish company Panofski
History of the Inventory Designer: In 1880, the "German Agricultural Council" suggested the creation of a "Reichszentrale zur Beobachtung und Vertilgung der die die Kulturpflanzen schädden Insekten und Pilze" (Reich Centre for the Observation and Eradication of Insects and Fungi Harmful to Cultivated Plants). On 24 March 1897, the Member of Parliament and practical farmer, Dr Dr hc. Albert Schulz-Lupitz in the Reichstag, an initiative for the creation of an "agricultural-technical Reichsanstalt für Bakteriologie und Phytopathologie". A necessity was given by the annual damages in the agriculture and forestry by diseases and pests of the cultivated plants and because of the importance of certain bacteria. This request was initially postponed until the following year and was finally dealt with again on 28 January 1898. On that day the Imperial Health Office demanded 2400 Marks for a "botanically trained unskilled worker" who would not only carry out the food examinations, but also the botanical work for the pharmacopoeia and the exploitation of plants from the protectorates, as well as be active in the field of plant protection. Finally, on 25 February, a commission met at the "Imperial Health Office" to discuss the planned establishment of a "Biological Department" at the Health Office and to draw up a first memorandum. The integration into this office was carried out because the now projected tasks (e.g. combating phylloxera) had been carried out there for years. The founding memorandum set out the tasks of the future research institute in eight points and became part of the "Law on the Determination of a Supplement to the Reich Budget Budget for the Financial Year 1898". In 1899 this department already comprised four laboratories in the newly built building of the "Imperial Health Office" in Klopstockstrasse in Tiergarten. Initially the department (see Reichstag printed matter no. 241, 1898): - study the living conditions of animal and plant pests of cultivated plants and gain the basis for their control, - study the damage to cultivated plants caused by inorganic influences, - study the beneficial organisms from the animal and plant kingdoms, - study the microorganisms useful and harmful for agriculture, and - study the diseases of bees. - In addition to the experimental activities, the following tasks were also assigned to the department: - Collecting statistical material on the occurrence of the most important plant diseases at home and abroad, - Provision of difficult-to-access literature (in particular from abroad) to the state institutes, - Publication of common publications and leaflets on the most important plant diseases, - Training of experts (for the German colonies). For field experiments, a test field was leased in Dahlem on the site of the "Royal Prussian Domain" at today's Königin-Luise-Strasse 19. In May 1898 the construction of a greenhouse with insulating cells and a small laboratory building began on this site. When the "Biological Department for Agriculture and Forestry at the Imperial Health Office" was founded, Oberregierungsrat Dr. med. h. c. Karl Köhler was director of this office. The first head of department was then in 1899 the Privy Councillor Prof. Dr. Albert Bernhard Frank, who died in 1900. His successor was Privy Councillor Prof. Dr. Carl Freiherr von Tubeuf, who was appointed to Munich after only a few months. In 1902, Dr. Rudolf Aderhold, Privy Councillor, became the new head of the government. He was followed on August 1, 1907 by the Privy Senior Government Councillor Prof. Dr. Johannes Behrens, former head of the "Bacteriological Laboratory". Files of the BRA Of the approx. 40 linear metres of the remaining records which had been preserved in the Federal Biological Institute for Agriculture and Forestry - Institute for Nonparasitic Plant Diseases - Berlin-Dahlem, the Federal Archives took over approx. 12 linear metres of archival documents in August 1983, including personnel files, most of the administrative documents and a selection of documents on implementation tasks. Around 1978, a considerable number of files, mainly from the Office for Economic and Legal Affairs in Plant Protection (WURA), had already been collected by the Federal Institute. In 1988, the Bernkastel-Kues branch and the Berlin Institute of the Federal Biological Research (Institut Berlin der Biologischen Bundesanstalt) handed over further files, in particular on viticulture and soil fertilisation (R 168 / 470-625). Personnel files In the 1950s, personnel files were mainly transferred from the Ministry of Agriculture and Forestry to the ZStA. These three named groups of files were brought together in the Federal Archives to form a single collection: R 3602 Biological Imperial Institute for Agriculture and Forestry. The Naumburg files retained the signature numbers 1 to 1020, the numbers of the files from the former R 168 were added around 2000 (R 168 / 1 became R 3602/ 2001), the 320 personnel files received the signature numbers R 3602 / 3001-3320. The ZStA had no further BRA files. It is suspected that the archival material handed over to the Reichsarchiv by the BRA and the other branch offices was destroyed during the destruction of the archive in April 1945. History of the Inventory Designer: Introduction Stones do not speak. Much less can or must entire buildings reveal the whole historical truth. National Socialism should work. Building under National Socialism also served this purpose, either directly on behalf of the system or indirectly at least by not opposing it. The enslavement of architecture by the regime was not limited to new buildings of the NS era. National Socialism also established itself in the stock, instrumentalised old buildings everywhere for its purposes. Not even all of the important command centers of the Nazi regime or the main sites of Nazi terror were housed throughout in buildings which, in historical retrospect, could be regarded as having their origin and function at the time. In the memory of the city and in the urban space, places of the perpetrators are handed down as places of the victims, whose role is only revealed in the explanation and commentary of their historical function in the "Third Reich". Prehistory until 1937 In the Third Reich, architecture served to express power and domination. This is particularly evident in the inner city of Berlin. The monumental new buildings in the imperial capital were intended to symbolize "German world standing". Adolf Hitler wanted to see "works created for eternity" in Berlin, "only comparable with ancient Egypt, Babylon or Rome," as he said in 1936. At the 1937 Reich Party Congress, Hitler announced: "... Therefore our buildings should not be thought for the year 1940, also not for the year 2000, but should project directly into the domes of our past into the millennia of the future." Soon after the seizure of power, propagandistically effective building projects were started. These included the Reich Aviation Ministry, Tempelhof Airport, which was to be expanded into a "world airport", and the Reich Sports Field, which was to be expanded and redesigned with a view to the Olympic Games. The powerful buildings were presented to the public with great journalistic effort. At the 1936 Reich Party Congress in Nuremberg, Hitler announced the "reconstruction of Berlin as the capital of the German Reich". Hitler had initially intended to have his plans for the reorganization of the inner-city area processed by the Berlin city administration. When he realised that the local authorities were reluctant to impose his far-reaching transformation fantasies, he changed the responsibilities for planning and building in the capital. On 30 January 1937, the young architect Albert Speer was appointed general building inspector for the redevelopment of the imperial capital (GBI), reporting directly to the "Führer". Organization and history from 1937 A few days after Speer's appointment, Hitler ordered the House of the Academy of Arts at Pariser Platz No. 4, which until then had belonged to the office of the Minister of Education, to be vacated for the office of the General Building Inspector. Within a year and a half, the GBI's planning staff alone grew to eighty-seven people, while the so-called implementing body employed the same number of staff. Speer appointed a number of equally competent and reliable people to the executive positions in the three main departments into which he divided the office: the head office, which administered the budget, was taken over by the financial expert Karl Maria Hettlage, the general site manager Walter Brugmann, who had got to know Speer in Nuremberg, and for the planning office, since it was objectively most important to him, he, in addition to Hans Stephan, called on two long-standing friends, Rudolf Wolters and Willi Schelkes, who had been associated with him since days of study. The Speers offices, which had been established successively since 1937, were not divided into three main offices until mid-1940 under the central management of the GBI. After his appointment to the GBI, Speer expanded his planning staff to the "office" of the GBI. This later Main Office I, Planning Office, was responsible for all planning matters, ordered more than one hundred areas of redesign by 1942 and set the respective clearance dates. From 1938, Jewish tenants were forced to cancel their tenancy agreements on the basis of the "Verordnung über den Einsatz des jüdischen Vermögens" (Ordinance on the Use of Jewish Property); they were admitted to Jewish houses and later to concentration camps. For the "resettlement" of Jews and the reassignment of the apartments, the GBI's "Implementation Office" had been set up under the direction of Karl Maria Hettlage. In this way about 18,000 apartments were requisitioned. Areas from which the Jews were completely expelled were described as "Jew-free". The number of buildings erected during the twelve years of National Socialist rule between 1933 and 1945 is surprisingly high, especially since it must be remembered that only six years were available during the Second World War. In November 1939, a ban on new construction was imposed due to the war, which was followed half a year later by the discontinuation of all construction measures not necessary for the war. The GBI was established by the Decree of 30 January 1937. The office itself was assigned to Albert Speer, who from 1934 was "the representative for construction in the staff of the deputy of the Führer" and as such had already established some Nazi party buildings, especially in Nuremberg. At first, the GBI's competence did not extend beyond Berlin and its immediate surroundings. The "Gesetz über die Neugestaltung deutscher Städte" of 4 Oct. 1937 does not yet contain a more detailed provision on the "agency commissioned" by Hitler himself to carry out these projects. Only in this way was it possible for a special "General Building Council for the Capital of the Movement" to be appointed to Munich by decree of 21 Dec. 1938 and for this office to be occupied by the NS party architect Paul Giesler; Giesler was also commissioned with the establishment of NS party buildings in Augsburg and Weimar. It was not until the third decree on the GBI of 18 Oct 1940 that the competence of the GBI was significantly extended. The latter was expressly declared a "commissioned body" within the meaning of the Act on the Redevelopment of German Cities. In the years 1938 to 1942, a total of 32 cities in the former Reich territory were included in the new planning on the basis of the law of 4 Oct. 1937 by decrees and ordinances promulgated in the Reichsgesetzblatt. As of the end of 1942, the progress of all urban development plans of a peace-related nature was completely halted, since tasks important to the war awaited solution and Speer himself had been largely involved in them since his appointment as Reich Minister for Armament and Munitions on 15 February 1942 and on 2 September 1943 as Reich Minister for Armament and War Production. With the decree of 11 Oct. 1943 on the preparation of the reconstruction of bomb-damaged cities, Speer was entrusted with the necessary tasks in his capacity as GBI. He had to determine the framework for the future design of the cities and the right to decide on urban development issues of the reconstruction cities in place of the Reich Minister of Labour. The elimination of the Reich Labour Minister, to whom Speer had previously been bound as GBI despite his direct subordination under Hitler, was above all a consequence of Speer's present position as Reich Minister. Inventory description: Inventory history In Germany, the General Building Inspector's collection for the imperial capital is divided into three archives: the Bundesarchiv, the Landesarchiv Berlin and the Bayerische Hauptstaatsarchiv Munich. A total of three finding aids were available in the Federal Archives for the inventory R 4606 General Building Inspector for the Imperial Capital. The holdings were brought together from Potsdam and Koblenz at the beginning of the 1990s and have since been known as R 4606 General Building Inspector for the Imperial Capital. In the Landesarchiv Berlin there are 1016 files as well as in the planning chamber there 1,000 sheets of the GBI under the signature A Pr.Br.Rep. 107 from the years (1935) 1937 to 1945. History of the Inventor: After Adolf Hitler had been appointed Reich Chancellor of the German Reich on January 30, 1933, the NSDAP gradually undermined the democratic system of the Weimar Republic over the following months and finally eliminated it. Decisive stages were the abolition of fundamental rights after the fire of the Reichstag on 28 February 1933 and the abolition of parliamentarism by the so-called Enabling Act of 23 March 1933. The latter abolished the separation of powers and conferred all legislative powers on the government under Adolf Hitler for four years. A further step was the smashing of the parties and unions. After the KPD had been banned, the trade unions dissolved and the SPD rendered incapable of action, the other parties dissolved on their own. In the course of these measures, the six existing municipal umbrella organisations also lost their independence. On May 22, 1933, the chairmen and managing presidents of the German/Prussian Association of Cities, the Reichsstädtebund, the Deutscher Landkreistag, the Deutscher Landgemeindetag, the Preußischer Landgemeindetag West, and the Association of Prussian Provinces were forced to give their consent to the transfer of the various associations into a new unified association. From now on, this "German Community Day" was to be the sole corporate representation of all German city and community associations recognised by the NSDAP. In order to standardize the previous associations with their 80 sub-organizations, the provisional Lord Mayor of Munich, Karl Fiehler, was appointed as "Representative for the Standardization of the Municipal Central Associations". The management of the new association was taken over by Dr. Kurt Jeserich, provisional director of the Institute for Municipal Science in Berlin, and Dr. Ralf Zeitler, speaker at the Reich Employers' Association. The merger process, which lasted for months, finally came to an end in the Law on the German Community Day of 15 December 1933, which finally established the formation of the new association. As the only existing communal top organization, the German Community Day, which as a corporation under public law was fundamentally subordinate to the Reich Minister of the Interior, was forced to include all cities, rural communities, administrative districts, provinces and later also the Reichsgaue in its capacity as self-governing government units. After the integration of Austria and the Sudetenland into the German Reich in 1938, the annexation of West Prussia, Gdansk and Poznan in the following year, the sphere of influence of the German Association of Municipalities was extended to the new parts of the Reich and their Gau administrations. In principle, the association took over the municipal representation of interests for all areas placed under German sovereignty. On February 14, 1934, Karl Fiehler, the previous commissioner for unification, was appointed the first chairman of the German Association of Municipalities. Fiehler was head of the NSDAP's local government department. The personal union was intended to coordinate the orientation of the NSDAP's work in local politics with the work of the German Community Congress and thus to comply with the principle of the harmony of party and state proclaimed at the 1933 Reich Party Congress in Nuremberg. The management of the German Association of Municipalities was subject to the instructions of the chairman and Reichsleiter of municipal politics. Through this entanglement of party and state authorities, the German Community Day came under the "organizations supported by the NSDAP", which was also partly advantageous, since the technical work could be made more effective under the supremacy of the party office. The association was now much more representative of the state. However, the idea of a unitary association with clearly defined tasks and closer ties to the state was nothing new; quite a few saw in it the possibility of better asserting municipal interests. The forced standardization and the practice of the totalitarian state, however, only allowed the possible advantages of the new uniform association to recede into the background. The association was supervised by the Reich Minister of the Interior, who appointed the chairman, the members of the board and the specialist committees. The executive committee and specialist committees were only allowed to meet after being convened by the minister, who also determined the agenda. In addition, he approved the budget and he himself or a deputy had to chair the committees. In addition to the 20 specialist committees, which only had the right to advise the chairman, the state and provincial offices were the only subordinate bodies of the Berlin office. Although the association had a highly centralised structure, the necessary expansion to include regional working groups and county departments in order to increase the exchange of experience led to an organisational structure that was comparable in its approach to that of the old associations. The fact that the association no longer had the right to represent municipal interests before the Reich and Land authorities on its own initiative had a particularly drastic effect. Only after a request by the authorities should the association be allowed to express itself from now on. Before 1933, however, it was precisely this right of initiative that had been decisive for the active representation of interests vis-à-vis the state and the self-determination of municipal associations as part of a pluralistic social order. Despite the organisational and political changes, the German Community Day also played an important role between 1933 and 1945, above all as a community advisory centre and as a mediator of practical experience in the field of local administration. Even the exchange between municipalities and state administration was by no means discontinued, which is evidenced by the active expert activities of the German Association of Municipalities (Deutscher Gemeindetags). A certain continuity in the association's work could also be ensured by the fact that a larger number of executives from the dissolved associations transferred to the new association. The organisational structure of the German Association of Municipalities was basically very similar to that of the German/Prussian Association of Cities. Thus the German Community Day took over the coat of arms of the German/Prussian Community Day, the Holstentor, and also its registry. The annual meetings of the German Association of Municipalities also followed on from similar events of the predecessor institutions. As a result of the bombing of Berlin during the Second World War, the German Community Day moved part of its administrative offices in August 1943 from Berlin to Wels/Upper Austria. The main tasks of the departments there were Ia (civil servants, employees and workers), II (finances and taxes), III (welfare, health and social policy), V (schools), Va (culture), VI (real estate, construction and housing) and Rv (defence of the Reich). It should be noted that only Division III with all registries moved to Wels. The other departments - probably only working staffs - took only parts of their registries with them. Also the cash administration and the personnel office moved to Wels. Departments Z (Central Department: General Administration, Management), I (Constitution and Administration), IV (Economy and Transport) and the Department for the Eastern Territories remained in Berlin. After the collapse of the German Reich in 1945, the German Community Day, due to its status as a "supervised organization", was regarded by the Allies as a part of the NSDAP's outlines and, together with the other organizations of the NSDAP, banned and formally dissolved. The administrator appointed by the Berlin magistrate for the concerns of the German Association of Municipalities did not succeed in correcting this misunderstanding. It was not possible to set up a kind of municipal chamber as the successor to the German Association of Municipalities. The "German Association of Cities", which had already re-constituted itself in 1946, was granted the right to ownership of the property of the German Association of Cities, but it could not bear the financial burden of the reconstruction and repair of the building on its own. Together with the Berlin Senate, the "Verein zur Pflege kommunalwissenschaftlicher Aufgaben e.V." was finally founded and established in 1951 as an asset holder of the German Association of Municipalities. The association, which was soon renamed "Verein für Kommunalwissenschaften", took over the office building in Straße des 17. Juni and also the files stored there. The building, today known as the Ernst Reuter House, was planned by Albert Speer for the German Community Day, erected from 1938 and finally occupied by the German Community Day in 1942. The German Association of Cities, the largest municipal umbrella organisation, initially set up its headquarters in Cologne due to its special status in Berlin. It was not until 1999 that the head office was partially relocated to the Ernst-Reuter-Haus in Berlin. In addition to the German Association of Cities and Towns, the central associations at district and municipal level were also newly formed after the Second World War. The Deutscher Landkreistag and the Deutscher Städte- und Gemeindebund, together with the Deutscher Städtetag, represent the most important municipal interest groups. The Federal Association of Municipal Central Associations offers these three associations the opportunity to present their interests in a bundled manner and to jointly express their views on overarching problems. Inventory description: Inventory history The inventory R 36 consists entirely of the files of the administrative offices relocated to Wels during the war. Apart from the cash documents and personnel files, the whereabouts of which could not be clarified, the Wels stockpiles have survived the war and the turmoil of the post-war period without any losses. They were taken by a member of the German Association of Communities via Linz/Donau, Offenburg, Frankfurt/Main to Siegburg, where the files were first kept at the newly founded German Association of Counties. With the approval of the Federal Association of Municipal Central Associations, the latter handed them over to the Federal Archives in 1953. The records in the Federal Archives represent only a small part of the total records. An estimated three-quarters of the total holdings, which consisted of the non-displaced registry parts of the German Association of Municipalities and the old registries of the dissolved umbrella organisations, remained in Berlin. After the Second World War, the files were stored at the Verein für Kommunalwissenschaften, which handed them over to the Landesarchiv Berlin as a deposit in 1968. There the German Community Day is registered today with 8600 file units. The second largest part of the collection is the legacy of the German and Prussian Association of Cities with 4286 files, whereby its war economy files from the years 1914 to 1918 form a separate collection with 1279 file units. Furthermore, the tradition of the Reichsstädtebund, the Association of Prussian Provinces, the German and Prussian Landkreistag, the German and Prussian Landgemeindetag and other associations that were absorbed into the German Gemeindetag in 1933 can be found in the Berlin State Archives. The German Association of Cities also handed over its old registrations to the Landesarchiv Berlin until 1985. Already in 1937/38 a small part of the files of the predecessor institutions of the German Community Day had been transferred to the Prussian Secret State Archives - today the Secret State Archives of Prussian Cultural Heritage. These holdings had been moved to Stassfurt during the war and then to the German Central Archive of the GDR, Merseburg Department. Today the tradition of the German and Prussian Association of Cities and Towns, the Association of Prussian Provinces, the Prussian County Council and the Prussian West Community Council is again in the Secret State Archives in Berlin-Dahlem. Documents of the German and Prussian Association of Cities, the Reichsstädtebund and the German and Prussian Landkreistag amounting to some 2600 file units, which had been transferred to the Reichsarchiv Potsdam in 1938, were lost in the fire at the archive building in April 1945. Archive evaluation and processing The present finding aid book represents a revision of the finding aid book produced in Koblenz in 1957. Volume counts, as far as they had been specified in the file numbers, were taken over for the volume sequences. In addition, further tape sequences were created for archiving purposes. The transactions contained in individual volumes ("booklets") were included in the titles. For the illustration of the volume and issue divisions, the file numbers are displayed in the index. Furthermore, the titles and the classification, which were based entirely on the file plan of the German Association of Municipalities, were slightly changed. For example, file plan items have been grouped together and the names of individual subgroups have been standardized. The changes were made carefully in order to reproduce as faithfully as possible the traditional registry order, as far as it has been preserved. There were no cassations. Furthermore, it should be pointed out that a large part of the files had been created by the predecessor institutions and then continued by the German Association of Municipalities after 1933. These were applications for admission and the questionnaire attached to the application for admission. The first structure of the stock resulted from the organization of the office of the Reich Treasurer of the NSDAP. Since 1937 this included the office of the chief of staff, the main offices I - VIII as well as two special commissioners, since 1939 also the office for lottery affairs, which had been separated from the main office I, and the office physician of the Reich leadership. The files from the access of the BDC originate from the areas of the Chief of Staff as well as from the main offices I, II, IV, V and VII. These are only relatively small parts of the files created in the individual offices with the exception of the files of the main office V. This major part consists of files relating to the NSDAP's asset management. Such files were created by the chief of staff and in the main offices I, III and V. The main part of them are files of the main office V on the administration of the party's own properties, buildings and homes. These are not only properties which were acquired or rented by the NSDAP for sale or by donation, but also those which originated from confiscated Jewish property within the territory of the Reich which had been transferred to the NSDAP or from hostile property in the territories incorporated and occupied before and during the Second World War. In a smaller subgroup of files, the administration is mainly reflected in the movable assets of dissolved associations and other organisations in the incorporated and occupied territories that have been transferred to the NSDAP. Additional information can be found in the corresponding volumes of the Hauptamt I and the Staff Chief, the latter also containing an incomplete list of NSDAP properties. The files of the Main Office III contain property overviews of the Gaue, districts and local groups of the NSDAP for the period from December 1936 to December 1938. In addition to annual and monthly balance sheets, the number of party members of the Gaue and districts is also indicated monthly, so that for the years 1937 and 1938 the growth of the NSDAP in the Gaue and districts can be followed. At that time, the receipts of the central accounting were cashed in the central, cash and asset management of the Hauptamt I. In the course of the further levies by the Berlin Document Center, the inventory was revised in 1988. However, the indexing was so different with regard to many different agents that the completion of a finding aid book was initially postponed. A complete revision of the holdings, including the 1293 archive units already recorded, was started in 2009. The existing classification according to the organization chart of the Reich Treasurer was adopted and only slightly changed. The individual head offices essentially worked according to the file plan, so that the classification of the files, provided they were still in their original state, was relatively unproblematic within the classification. It was more difficult to assign the files taken over from the BDC. In the BDC, files were for the most part newly created according to the pertinence principle, so that especially in the area of the Membership Office, documents from the Arbitration Office, the Card Index Office and the Admission Office can be found in one file. Since the files were already in use, however, a reorganization of individual files was dispensed with, also for reasons of time. Only too large files were separated. The files were indexed in accordance with the valid indexing guidelines for the Federal Archives and included corrections (nominal style, valid grammar and spelling rules) and the adaptation of titles (often abbreviations) in accordance with the technical possibilities of the BASYS S database. History of the Inventory Designer: Introduction Prehistory up to 1933 The rapid increase in car traffic after the First World War meant that road construction in Germany had to face up to these new requirements. The aim was to rapidly improve the existing road conditions and adapt them to the new requirements of increasing motorisation by extending the existing country roads and building motorways. Contemporary statistics show that in 1924 every 321st inhabitant in Germany owned a "car", while at the same time in France every 90th, in Great Britain every 71st and in the USA already every 7th inhabitant owned a car. The private German vehicle fleet in the country doubled in the years from 1923 to 1926 from 100,340 cars to 206,456. In 1933, only seven years later, almost 800,000 motor vehicles were registered in Germany. The construction of the Berlin AVUS (Automobil-Verkehrs- und Übungs-Straße) in 1921 as well as the activities of the Studiengesellschaft für Automobilstraßenbau (STUFA) played a special role, the latter in particular with regard to the extension of the existing country roads. However, the war and its consequences prevented a resumption of this discussion until the mid-twenties. With the founding of the association HAFRABA and its transition to GEZUVOR, plans for the new motorways in particular took shape, which, after the National Socialists took power, were quickly declared to be the "Führer's Roads". In the course of its work, HAFRABA drew up about 70 plans for a motorway network in Germany. The later central and territorial road construction administrations were able to profit from many results of their complex research, test series, but also from studies for the job creation of larger quantities of labour. The existing conditions with regard to the road administration in the respective sovereign jurisdiction on the one hand and the (Reich) legislator on the other, as well as the increasing blockage of road construction plans from Reich railway and financial circles, but also from the Länder and provinces, forced the necessity of a reorganisation of the road system in Germany to a certain extent, which did not take long after the seizure of power by the Hitler dictatorship. Adolf Hitler was not yet Chancellor of the Reich for two weeks when he put the construction of intersection-free motorways up for discussion in the cabinet. As early as 11 February 1933 he announced the "initiation and implementation of a generous road construction plan", with which both a modern transport system was to be created and unemployment effectively combated, but also reaped the opposition of Reichsbahn General Director Dorpmüller and Reich Finance Minister Count Schwerin von Krosigk. Nevertheless, he was determined to discuss the necessity of motorways with transport experts and leading representatives of the economy. In a conversation with HAFRABA managing director Willy Hof on 6 April 1933, he was informed in detail about the association's plans. As early as 27 June 1933, the Reich government announced, against the will of the Reichsbahn representatives, the formation of the company "Reichsautobahnen", which initially acted as a branch of the Deutsche Reichsbahn-Gesellschaft. One day later, Hitler appointed Dr. Fritz Todt, a highly intelligent civil engineer who was loyal to the line, as "Inspector General for German Roads". With the later "Decree on the General Inspector for the German Road System" of 30.11.1933, Todt was also transferred the business area of the company "Reichsautobahnen". The decree states: "For the execution of the construction of the Reichsautobahnen ... a supreme Reich authority shall be established with its seat in Berlin, the head of which shall be given the official title of 'General Inspector for the German Road System'. He is appointed by the Reich President at the suggestion of the Reich Chancellor and reports to the Reich Chancellor. Hitler was convinced of Todt's suitability after he had read his so-called "Brauner Bericht" (Brown Report), a memorandum on "Road Construction and Road Administration", in which Todt deals with the previous conditions of road construction in Germany and formulates objectives for the time of National Socialism. The new authority had the task to organize the construction of the "Reichsautobahnen" and the maintenance of the country roads, as far as they had belonged so far to the responsibility of the Reich Minister of Transport. Legal foundations The "Gesetz über die Errichtung eines Unternehmens Reichsautobahnen" of 27 June 1933, the first ordinance of 7 August 1933 and the "Gesetz zur Änderung Gesetz über die Errichtung eines Unternehmens Reichsautobahnen" of 18 December 1933 provided the Inspector General with a foundation of powers and authority which enabled him to implement the goals set by the Reich leadership as quickly as possible. This included the right to route and design the Reich's motorways as well as the right to levy charges, the right of expropriation and the assumption of state sovereign rights over the motorways. With the "Act on the Temporary New Regulation of the Road System and the Road Administration" of 26 March 1934, the division of roads into 1st motorways, later "Reichsautobahnen", 2nd Reich roads, 3rd country roads of the 1st order, 4th country roads of the 2nd order, was also introduced. The law of the land was amended in accordance with the provisions of the first order, and further regulations were made regarding the distribution of the road construction load, the administration of the Reich roads and the country roads of the first order, the road supervisory authority, etc. A general power of attorney to the greatest extent possible was granted to the Inspector General with the formulation written down in § 1 "The Inspector General for the German Road System determines which roads are subject to the provisions of this Act and which roads have the characteristics of Imperial roads and of Land Roads I. and II. I'll give you the order." The prerequisites created by the aforementioned legal bases were very soon reflected in the structure and organisation of the office of the Inspector General for German Roads. Organization and Structure In 1934, the Inspector General's Division comprised the two major areas of responsibility, Land Roads and Reich Motorways, as well as the resulting connections to the 30 Supreme Road Authorities with 176 State Construction, Road and River Offices of the Länder and Provinces on the one hand and the 15 Supreme Construction Supervisors with 65 Construction Departments for the motorways on the other. As a result, the internal service structure was as follows: Four departments were assigned to the Inspector General for German Roads. 1. department Landstraßen (L), 2. department Administration/Administration (V), 3. department Research/Exhibition/Congress (F) 4. department Reichsautobahnen (A) Furthermore, a landscape consultant was assigned to the Inspector General. In addition to a joint press and socio-political speaker, departments L and A were each assigned 5 speakers (L1 to L5 and A1 to A5), whose fields of work extended to cooperation with the road construction authorities in the Länder and provinces and with the supreme construction managers of the motorways. An overview of the road construction authorities from 1935 under the authority of the Inspector General illustrates the striving for a strongly centralised connection of road construction tasks in Germany. After Hitler's declaration on January 30, 1937, that the German Reich had regained unrestricted sovereignty over the Deutsche Reichsbahn and that the Deutsche Reichsbahn had been converted into a pure Reich administration by the law of February 10, 1937, the Reichsautobahnen were to be given a position similar to that of the Deutsche Reichsbahn. This was done in the "Gesetz zur Neuregelung der Verhältnisse der Autobahn" of 1 July 1938 and by the "3. Verordnung zur Durchführung des Gesetz über die Errichtung eines Unternehmen 'Reichsautobahnen'" of 1 June 1938. Fritz Todt was appointed chairman of the board of the Reichsautobahnen. The offices of the company became direct Reich authorities. Thus the company Reichsautobahnen lost its character as a society. The "Führerprinzip" (leader principle) practiced in all authorities of the "Third Reich" dominated the organization of the Reich's motorways at the latest since the enactment of this law. With the rapid progress of the political and economic processes in Germany, with rearmament, with the creation of ever new political and organizational structures in the Reich territory, with the invasion of Austria and the Sudetenland, with the erection of the Westwall after the occupation of the demilitarized Rhineland and finally with the beginning and course of the war, ever new and different organizational units and focal points of work developed within the office. The supreme construction management of the Reichsautobahnen was extended by similar authorities in the occupied areas. In the construction of the Westwall from the middle of 1938 onwards, the 22 superstructure superstructure lines at the German western border were firmly integrated, after Hitler, under heavy accusations against the General Staff of the Army, had given this task to Todt without further ado - it was the hour of birth of the "Organisation Todt". It had its first seat as Abteilung West in Wiesbaden. In the files of the Inspector General for the German Road System, an interweaving of tasks with other ministries (e.g. Reich Ministry of Transport, Reich Ministry of Finance), the NSDAP as well as the cooperation with many other organisations is reflected in many ways, e.g. the National Socialist Association of German Technology (NSBDT), the German Labor Front (DAF), the National Socialist Motor Corps (NSKK) and the German Automobile Club (DDAC), and many others. The business distribution plan of the Inspector General of October 28, 1938 clearly expresses that the company was already at the level of political development. Directly subordinate to the Inspector General were now not only the 4 departments but also three other business areas: Research, NSDAP compounds, imperial defence and defence (cf. Fig. page XII). Fritz Todt held a number of political offices. From 1933 he was not only Inspector General for German Roads, but also Head of the Main Office for Technology of the NSDAP, 1938 he became General Plenipotentiary for the Regulation of the Construction Industry, 1940 Reich Minister for Armament and Ammunition as well as Inspector General for the Special Tasks in the Four-Year Plan, 1941 Inspector General for Water and Energy. At the height of his political career Todt died in a plane crash on 8 February 1942 near the "Führerhauptquartier" near Rastenburg/ East Prussia. Albert Speer took office on 9 February 1942. Inventory description: Inventory history The inventory summarised in inventory R 4601, General Inspector for the German Road System, consists of several parts from the former GDR and the Federal Republic of Germany. This includes around 2,300 files and almost 1,800 card index sheets from the former Central State Archives of the GDR, which were formerly kept there as holdings 46.01 and were recorded in a finding aid file, some of them with very general and inaccurate title records. The files of the holdings R 65 I to R 65 IV described below were added from the Federal Archives. Here, finding aids with precise title entries and notes on contents were available. In addition to Todt's "Brounen Denkschrift" (Brown Memorandum), the R 65 I holdings included 34 other files from US returns from 1934 to 1945, as well as files from the Building Department Wittlich 1941 (1), the Wiesbaden Department 1938-1943 (2), the Böttger 1938-1945 (11), Bonacker 1937, 1942-1944 (2), Dittrich 1926-1952 (67), Schönleben 1939-1944 (6), and supplements 1939 (1). The collection R 65 II contained 141 files of the Reichsautobahndirektion Berlin and was handed over to the Federal Archives by the Federal Minister of Transport in 1962 (official files of the Federal Archives, file no.: 3115/4, note dated 31 Jan. 1962). The inventory R 65 III was a collection of decrees of the Inspector General. The inventory R 65 IV contained personal files, of which 112 files have been catalogued and a further 12 running metres have not been catalogued. Archival evaluation and processing The inventory was indexed using the above-mentioned finding aids by entering it into the BASYS-S database of the Federal Archives for the purpose of making the finding aid data available online. A physical reception of the files did not take place due to time reasons with some exceptions. The archive signatures of the Potsdam holdings were largely retained during the indexing process, but each volume was given its own archive signature for found files with volume numbers. The signatures begin: at no. 1 for the former stock 46.01, at no. 3001 for the former stock R 65 I, at no. 4001 for the former stock R 65 II, at no. 5001 for the former stock R 65 III, at no. 10001 for the former stock R 65 IV. The 112 personal files already opened up have been newly recorded, but are not part of this finding aid book. The existing classification was largely renewed and is based both on the organizational structure of the inventory generator and on its functional responsibilities. The internal order of the files has been maintained. The inventory has already been moved from standing folders to folders. 1 History of the authorities 1.1 Military Provinces 1813-1815 On 15 March 1813, for strategic military reasons, the entire Prussian territory between the Elbe and the Russian border was divided into four military provinces in order to wage war against France. At the same time, the Upper Government Commission founded in Berlin on 20 January 1813 (cf.: GStA PK, I. HA, Rep. 102 Oberregierungskommission zu Berlin) and the General Commission for Accommodation, Meals and Marschesen formed on 24 April 1812 (cf.: GStA PK, I. HA, Rep. 85 General Commission for Accommodation, Meals and Marschesen) were dissolved. Initially, four military provinces were formed for the following areas: 1) for the country between the Elbe and Oder rivers in Berlin, 2) for the country between the Oder and Vistula rivers in Stargard, 3) for the country between the Vistula and the Russian border in Königsberg and 4) for Silesia in Breslau. After the further advance of the Prussian and Allied troops, the formation of the military government for the Prussian provinces took place on the left bank of the Elbe. This was soon divided into the two military provinces for the state between the Elbe and Weser in Halberstadt and for the state between Weser and Rhine in Münster. The military governorates were classified according to purely military or geographical criteria, irrespective of the historical administrative divisions that existed to date. The individual military governorates were directly subordinate to the king or the state chancellor. The ministries lost their competence for all matters concerning warfare for the duration of the military governorates. All authorities in the district were subordinate to military or civil governors in military matters. Only in operational matters of the army was the commanding generals in command. For each military government, one military governor and one civil governor were appointed as equal leaders. In the event of disagreement, the King alone had the power of decision. In the event of imminent danger, however, the military governor had the decisive vote. Part of the tasks of the military government, especially with regard to the provision of food for Russian troops, was transferred to the Major General Friedrich Karl Heinrich Graf von Wylich and Lottum as General Director for the provision of food for Russian troops in Germany on 11 March 1813 (cf.: GStA PK, I. HA, Rep. 128 Registratur[by Friedrich Karl Heinrich Graf von Wylich and] Lottum über Armeeverpflegungsangelegenheiten in den Kriegen 1813 - 1815). After the First Peace of Paris, the four Eastern Elbe military provinces were dissolved by the cabinet of 3 June 1814. The two Westelbian military provinces remained in place for the time being. 1.2 Military and civil government for the provinces between the Elbe and Weser The "Military government for the Prussian provinces on the left bank of the Elbe" was formed by the Kabinettsordre of 9 April 1813 and Wilhelm Anton von Klewiz was appointed civil governor. Major General Philipp of Ivernois was appointed military governor, but he died on June 1, 1813. The new military governor was Major General Friedrich Wilhelm Ludwig von Krusemark. Since most of the West Elbian areas were still occupied by French troops, it took some time before the military government was able to take up its activities in full. The seat of the military government was initially still in Berlin and was moved provisionally to Halle/Saale only in October 1813. As a result of the advance of the Prussian and Allied troops, the area to be administered by the military government had assumed too great an extension. For this reason, the Cabinet of 19 November 1813 divided it into two independent military provinces for the provinces between the Elbe and Weser and between the Weser and Rhine. The former civilian governor of Klewiz, who held this office until the dissolution of the civilian government, was appointed civil governor of the military government for the provinces between the Elbe and Weser rivers. The new military governor was Major General Ludwig Wilhelm August von Ebra (1759-1818). The military government now comprised the following former Prussian territories: the Altmark, the Duchy of Magdeburg, the Principality of Halberstadt, the County of Mansfeld, the County of Hohenstein, the Principality of Eichsfeld and the Principality of Erfurt. The seat of the government administration was moved to Halberstadt in December 1813. Although a division of responsibilities between the military governor and the civilian governor would have been legally permissible, all business of the military government was handled jointly and amicably by both governors. In the event of absence, there was mutual representation. The office and the registry were managed jointly. Even after the peace agreement of May 30, 1815, the military government remained in place and was not dissolved until July 12, 1815. The military tasks were transferred to the General Command for the provinces between the Elbe and Weser rivers. The remaining business was provisionally continued by the former civil governor of Klewiz until the appointment of the chief president and the district presidents on 1 April 1816. The main task of the military government was to reorganize the administration and ensure the efficiency of the Prussian army in the provincial district. These included above all the formation of troops, feeding the Prussian and Allied troops and supplying the military hospitals. For this purpose, the military government had to raise the necessary funds through tax collections and carry out requisitions. The higher and security police were also directly exercised by the military government. However, the mining and metallurgy sector was directly subordinated to the Minister of Finance and the postal sector to the General Postmaster. In order to carry out individual tasks of the military government, several subordinate offices and authorities were formed, which were also based at the civil governor's place of work in Halberstadt. This included the Finance Commission, which exercised control over the management of direct and indirect taxes, domains and forests. This commission was dissolved on 24 February 1814. Its tasks were largely transferred to the Provincial Commission, which was also based in Halberstadt. This commission consisted of six councils and served to advise the civil governor, on whose decisions it was also dependent. It was therefore not an independent intermediate instance between the civil governor and the subordinate authorities. On behalf of the Military Government, the Higher Regional Court Council Dalkowski conducted investigations against a number of persons suspected of espionage and spying for the French or Westphalian High Police or army. The basis for these investigations was the Royal Order of 17 March 1813 for punishment of crimes against the security of the armies (cf.: Collection of Laws for the Royal Prussian States, 1813, p.34f.) and the Decree of 15 January 1814 for investigation and punishment of the illicit traffic with the enemy (cf.: Collection of Laws for the Royal Prussian States, 1814, p. 5-7.). However, under Article 16 of the First Paris Peace of 30 May 1814, these investigations had to be stopped. In November 1813, the Provincial War Commission was formed to carry out the requisitions and supply the Prussian and Allied troops. This office, headed by the provincial war commissioner Rhades and, from February 1814, his successor Lehmann, existed until 1816 and a surgical staff was formed for the organization of the provincial hospital system. This staff existed until November 1815 and was responsible, among other things, for the purchase of medicines and hospital utensils, the recruitment and remuneration of medical personnel and the supervision of the individual provincial hospitals. At the end of 1813, the territory of the military government was divided into three departments, each headed by a national director. These national directorates were intermediate instances between the civil governor and the district administrators or the subordinate authorities. The three departments can be regarded as predecessors of the administrative districts that were later formed. The first department roughly corresponded to the former Westphalian Elbe department and consisted of the districts Salzwedel, Stendal and Neuhaldensleben. Due to the occupation by French troops, the city of Magdeburg was no longer under direct administration until May 1814. The second department, which roughly corresponded to the Westphalian Saale Department, consisted of the Saalekreis and the districts of Wansleben, Calbe/Saale, Mansfeld, Eisleben, Halberstadt and Osterwieck. The 3rd department consisted of the Prussian parts of the former Westphalian Harz Department and was divided into the districts of Heiligenstadt, Duderstadt and Hohenstein. In addition, there was the area of Erfurt and Blankenhain, which formed its own circle and was administered by its own vice director (as permanent representative of the country director). The national directorates in the 1st and 2nd departments were dissolved in February 1814 and the competencies were transferred to the civil governor or the responsible councillors. However, due to the long distance until the dissolution of the civil government on 31 March 1816, the Regional Directorate of the 3rd Department remained in place. When the administrative districts of the province of Saxony were later formed, the previous territorial structure of the three departments was largely retained. The files, which concerned the areas of the later administrative districts of Merseburg and Erfurt, were first transferred to the responsible government archives in Merseburg and Erfurt and were later added to the holdings of the Magdeburg State Main Archives. By order of the Director General of the Prussian State Archives of May 1, 1883, the files of the military government (with the exception of the military government for the land between the Elbe and Oder or Oder and Vistula) were either transferred from the Secret State Archives to the provincial archives concerned or left in their original state. On 26 and 27 April 1972 the above holdings were transferred by the Landeshauptarchiv Magdeburg to the Deutsches Zentralarchiv, Dienststelle Merseburg (see: GStA PK, I. HA, Rep. 178 E Geheimes Staatsarchiv PK, Dienststelle Merseburg, Nr. 331 Aktenzugänge, Bd. 1). However, not all stocks from the transitional period were transferred. Thus, for example, the holdings of the three state directorates remained in the Magdeburg State Main Archives. On 21 October 1986, 0.1 running metres of files were subsequently taken over and assigned to the holdings (cf.: GStA PK, I. HA, Rep. 178 E Geheimes Staatsarchiv PK, Dienststelle Merseburg, Nr. 1037 Bestandsakte I. HA Rep. 91 C). The holdings taken over from the Magdeburg State Archives were combined into one holdings and initially recorded in a find file by employees of the German Central Archives, Merseburg Office. In the process, the contemporary titles were obviously adopted without any discernible new titles being formed. In addition, the portfolio was rearranged according to thematic criteria. It has not yet been possible to determine the date of the order, the original distortion and a later revision of the file titles. This revision, which was still carried out on the index cards, led to a partial correction and standardisation of the file titles, which however remained incomplete and inconsistent. Following the retroconversion of the find file by typists of the Secret State Archives PK, the holdings were edited in 2008 and 2009 by archive employee Guido Behnke. The classification has been revised. In addition, the existing file titles were checked and, if necessary, standardized or corrected. In some cases, individual files had to be redrawn. The existing place names were adapted as far as possible to the current spelling. 3. note on use The holdings were arranged according to subject matter. However, the files of classification group 02.01.03 are sorted by the names of the individual towns. These are files relating to the accounting, the debts, the public buildings, the leasing of land and the local taxes of the respective municipalities. Also the files of the classification group 03.03.01.03, which concern the church, parish and school affairs, are arranged according to place names. The files relating to staff matters (e.g. employment, remuneration, dismissal, misconduct) of officials should be sought in the various thematic classification groups. For example, the files on civil servants employed directly by the Military Government are in classification group 01.02, municipal civil servants in classification group 02.01.04 and judicial officers in classification group 02.03.01.09. 4. On the postal history of Baden between 1872 and 1934: in 1811, the Grand Duchy of Baden took the postal system out of the hands of Thurn und Taxis and transferred it to state control. A postal directorate was created, which in 1814 was transformed into a regional postal directorate. In 1843, after the introduction of the railway, the "Direktion der Posten und Eisenbahnen" (Directorate of Posts and Railways) was created, which was renamed "Direktion der Großherzoglich Badischen Verkehrsanstalten" in 1854. In connection with his entry into the German Reich, Baden renounced his postal sovereignty. On January 1, 1872, the Baden Postal Correspondents were transferred to the Imperial Imperial Post Office, after the railway system, which had not been handed over, had been separated from the postal administration again (see Resistance Group 421). After 1872, the real estate assets of the Baden Post remained the property of the Baden State, but could be used by the Reichspost, which of course remained free to purchase new land and buildings for its own purposes. The Reichspostverwaltung set up two Oberpostdirektionen (OPD) in Baden as the central authority, based in Karlsruhe and Constance, whose mutual borders ran south of the Kehl-Appenweier-Oppenau railway line. The OPD Karlsruhe was also assigned the Hessian district of Wimpfen, the OPD Konstanz the Prussian part of Hohenzollern; both areas were also looked after by the Reichspost, while the neighbouring kingdom of Württemberg had kept its own post office after 1871. The two Oberpostdirektionen were subordinated to the General Post Office (from 1880 Reichspostamt, from 1919 Reichspostministerium) as the higher authority. Since telegraphy in the North German Confederation had been subject to its own "General Directorate of Telegraphs", in 1872 telegraphy in Baden had also been removed from the jurisdiction of the post office. But already on 1 January 1876 the fusion of post and telegraphy took place in the Reichspost area. From now on the telegraph stations in Baden were subject to the two regional post offices and the Reichspostamt, partly as independent telegraph stations or offices, but mostly united with post offices. In 1934 the OPD Karlsruhe, like the other regional post offices of the Reich, was renamed "Reichspostdirektion" (RPD). On the basis of the Act of 27 February 1934 simplifying and reducing the cost of administration, which was fundamental to the postal and telecommunications sectors, the Constance OPD was dissolved with effect from 1 April 1934 and, after a transitional period, finally ceased to exist on 1 October 1937. Its territory was assigned to the RPD Karlsruhe, which also took over the files of the OPD Konstanz and partially continued them. Explanations on holdings 419: The majority of the files listed in this finding aid were delivered by the RPD Karlsruhe in 1941 (access 1941-17). The smaller part was taken from the deliveries of the OPD Karlsruhe 454 access 1980-30, 419 access 1981-49 and 454 access 1982-18 according to provenance. The OPD Karlsruhe kept an old registration of about 1500 running meters. Files from the foundation of the Reichspostverwaltung in 1872, of which only the aforementioned access had reached the Generallandesarchiv in 1941. After the General State Archives had tried in vain in 1961 to deliver the remaining documents, the OPD had the entire old files destroyed without consulting the archives by house decree of 20 April 1970. This means that the only closed old register of an OPD in Germany, which also contained the documents of the OPD Konstanz, which was dissolved in 1934, has been lost. The duration of the material files of inventory 419 essentially covers the period 1872-1945. Only a few files of the management of the Großherzoglich Badischen Verkehrsanstalten and collections of circular decrees of the General Post Office Berlin to Prussian Oberpostdirketionen, which had apparently been handed over to the OPD Karlsruhe as information necessary for the course of business, continued in the Oberpostdirketionen and date back further. Some files of the access 1941 were classified in the personal files (see below), one file came according to its provenance to stock 418, six files were cashed. Since the numbering of the access was maintained 1941-17, the following numbers are no longer used: 1-7, 10, 11, 13, 65, 121-128, 193, 522, 676, 697, 713, 720, 753, 758, 774, 838, 883, 935-936 and 939-940.The older personnel files of inventory 419 have been added to the General State Archives with the additions 1938-42 (61 personnel files of the OPD Konstanz), 1941-17 (6 personnel files of the OPD Karlsruhe) and 1981-49 (2252 personnel files of the OPDn or RPD Karlsruhe and Konstanz and the OPD Karlsruhe after 1945). The personnel files of the 1941 access were incorporated into the 1981 access and the list of consignments was supplemented accordingly. Song and processing of the inventory: A file plan for the RPD documents is not available and could not be obtained from the OPD Karlsruhe. For example, the classification of the inventory is based on the usual division of the postal and telecommunications sectors into operations and administration, with attempts being made to reconstruct the file plan from the registry signatures on the file covers. The greater part of the documents are special maps, which were led by the OPDn to the individual transport companies of their district. These are post offices, postal agencies, postal branch offices, railway post offices, postal auxiliaries and independent telegraph stations or offices. These files shall regularly contain the following documents: Professional records, audit reports from post offices, inventories, duty schedules, guides for the training of postal and telegraph staff, which are no longer mentioned in the repertory itself. - 1 The Dukes of Urach Counts of Württemberg: The Dukes of Urach Counts of Württemberg are a branch line of the House of Württemberg. In 1800 the fourth son of Duke Friedrich Eugen von Württemberg, Duke Wilhelm von Württemberg, married a court lady of his mother: twenty-three-year-old Wilhelmine von Tunderfeld-Rhodis. According to the house laws, this marriage with a woman who did not come from the high nobility was uneven; Duke Wilhelm therefore renounced the succession to the throne for his descendants on August 1, 1801. On 20 April 1801 the reigning Duke Friedrich, Duke Wilhelm's eldest brother, had already recognised the marriage as a full marriage to the right hand and determined that the descendants of Duke Wilhelm should bear the name Counts of Württemberg. Thus a new branch line of the House of Württemberg was created. The second son, Count Wilhelm, who also bore the name Wilhelm, was raised to the rank of first Duke of Urach by King Karl in 1867. The new ducal dignity was hereditary in the male tribe; the corresponding elevation of the younger children to the princedom was to underline the close connection of the branch line with the main line and determine its rank immediately after the royal house before all other class masters of the kingdom. Through the conversion of Wilhelm I to the Catholic denomination of his wife and children in 1862, the House of Urach became a consciously Catholic dynasty of princes from the very beginning. With the construction of the Lichtenstein Castle on the Albrand above the Echaztal in 1840/41, the Duke, who died in 1869, set himself a lasting monument. The genealogy reproduced after the preface is also taken from this. 2.1 The total holdings of the Archives of Duke of Urach Count of Württemberg: The holdings listed here, the estate of Wilhelm II Duke of Urach Count of Württemberg, represent part of the total archives of the family. This was kept at Schloss Lichtenstein until 1987. Due to a deposit agreement between H.S.H. Karl Anselm Duke of Urach Count of Württemberg as representative of the Herzog family of Urach Count of Württemberg and the State of Baden-Württemberg, represented by the Hauptstaatsarchiv Stuttgart, dated 14 July / 5 August 1987, it has been deposited in the Hauptstaatsarchiv Stuttgart since then. Because of their literary references, parts of the documents of Wilhelm I and Count Alexander were simultaneously handed over to the German Literature Archive in Marbach, where they are stored under the signature D 88.6. The archive was completely unsorted when it was transferred to the Main State Archives. Nor were there any finding aids that could have been reused. Only a part of the documents is listed in a directory of 1927/28, which was included in the delivery; in addition, the order on which this directory is based was fundamentally destroyed at an unknown time. A large part of the material was unpacked or stored in open cartons. In 1995, Archive Director Dr. Wolfgang Schmierer carried out an initial inspection, tidying and preliminary packaging of the material. He subdivided the entire collection into partial collections, to which he assigned signatures corresponding to the numbering of the family members in his article on the Herzog von Urach Graf von Württemberg family, which was written parallel to the work on order. The GU 1 et seq. sub-funds to be structured in more detail comprise documents on real estate and asset management. The GU 100 sub-collection contains foreign archives and collections. The GU 101 - 134 partial holdings were created as personal estates of individual family members and GU 201 - 203 of related parties. Some overlaps were inevitable. If documents were kept throughout the period of activity of a single duke, they were assigned to the signatures GU 1 et seq. in the order An overview of the current status of the subdivision into partial holdings can be found below. It is possible that the structure will be modified in the course of further development work. An impressive record of Wolfgang Schmierer's work from February 10, 1995 to March 21, 1996 (Kanzleiakten 7511.5-2-D.1: Erschließung des Archivs der Herzöge von Urach) provides information on the orderly work carried out by Wolfgang Schmierer. 2.2 The subportfolio GU 117: The following subportfolio GU 117 Herzog Wilhelm II. von Urach comprises documents, which Wolfgang Schmierer has formed in the course of his order work Wolfgang Schmierers. Duke Wilhelm II (1864 - 1928) was born as the first son of Wilhelm I and his second wife Princess Florestine of Monaco in Monaco and already at the age of five the second Duke of Urach. He entered the traditional military career and was commander general of the Generalkommandos z.b.V. in the First World War. No. 64 and General of the Cavalry. In 1927 the volume Die 26. Infanterie-Division im Weltkrieg 1914 - 1918, Teil I 1914 -1915, edited by him, appeared in the series Württembergs Heer im Weltkrieg. Wilhelm II. ran several times for a vacant throne: 1910 for Monaco, 1913 for the new Kingdom of Albania, in the war for Poland and for a Grand Duchy of Alsace-Lorraine and 1918 for the planned Kingdom of Lithuania. Arnold Zweig used the episode of his election as King of Lithuania, in which he was given the name Mindaugas II, in his 1937 novel Einsetzung eines Königs. In 1922 Wilhelm, who devoted himself to scientific activities after the war, received his doctorate in philosophy from the University of Tübingen with a dissertation on the urban geography of Reutlingen. Wilhelm II married Amalie Herzogin in Bavaria in 1892 (1865 - 1912). The marriage produced four sons (Wilhelm III, Karl Gero, Albrecht, Eberhard) and five daughters (Maria Gabriela, Elisabeth, Carola Hilda, Margarethe, Mechthilde). In his second marriage he married Wiltrud, née Princess of Bavaria, in 1924, and since the partial holdings of Duke Wilhelm II are particularly extensive and of particular importance in many respects (applications for the throne, constitutional status of the House of Urach, World War I), Wolfgang Schmierer, in agreement with the Landesarchivdirektion Baden-Württemberg, made the decision to place his indexing at the beginning of the indexing of the entire holdings and to apply for third-party funding. Within the framework of a project of the Stiftung Kulturgut Baden-Württemberg, which we would like to take this opportunity to thank sincerely for its support, the temporary employee Hansjörg Oswald was able to demetalise, open up and package GU 117 in the period from November 1995 to July 1997.
